C~ ~' ~ (~ AN ORDINANCE VACATING THE NORTHERLY 26-FEET OF THIRD STREET ABUTTING LOT 15(LESS THE WESTERLY 7.69 FEET) AND LOT 16 IN BLOCK 4, NATIONAL CITY ADDITION TO THE CITY OF PORT TOWNSEND; ESTABLISHING CONDITIONS TO THE STREET VACATION; AND ESTABLISHING AN EFFECTIVE DATE. t PA/ : q74/- 7oo - WHEREAS, the City Council for the City of Port Townsend has considered Street Vacation Application No. 9505-08 (Robert and Mary Weidner), and following due notice has held a public hearing upon the application; and WHEREAS, the City Council for the City of Port Townsend adopted its Findings of Fact and Conclusions on July 3, 1995; and WHEREAS, the applicant has paid to the City one-half of the appraised value of the area to be vacated; and WHEREAS, the required easements have been retained; and WHEREAS, a restrictive covenant describing Lots 5-8 and Lots 15-18 (less the westerly 7.69 feet of Lots 8 and 15) and that portion of Lot 18 lying northwesterly of the Olympic Gravity Waterline easement, all within Block 4 of the National City Addition, and prohibiting the sale of any portion of said lots unless sold in conjunction with the remainder of said lots has been executed and recorded at the Jefferson County Auditor's Office; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DOES ORDAIN AS FOLLOWS: Section 1. That the following street is hereby vacated to Robert and Mary Weidner: the northerly 26-feet of Third Street abutting Lot 15 (less the westerly 7.69 feet) and Lot 16 in Block 4, National City Addition to the City of Port Townsend, reserving therefrom an easement ten feet in width parallel to the Northwesterly boundaryi.~ a strip of land conveyed to the City of Port Townsend by Section 2. instrument dated March 10, 1906, and filed under Auditor's file No. 21911, records of Jefferson County, Washington That the street vacation aforementioned is conditioned, however, on the following: A certified copy of the ordinance vacating the street shall be recorded by the City with the office of the Jefferson County Auditor. Any existing utility easements including the Puget Power and Olympic Gravity Waterline easements shall be retained. The City shall have the right at all times to enter the reserved easement area for the purposeof inspecting-and maintaining:the property, including but not limited to maintaining, improving, repairing, constructing, reconstructing, locating and relocating any utility lines. Construction or placement of structures or storage within the above-described reserved easement area is prohibited. Section 3. This ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law, and after it has been recorded with the Jefferson County Auditor pursuant to Section 2 of this ordinance. Read for the first, second and third times, passed by the City Council for the City of Port Townsend and signed by the mayor of the City this 16th day of June, 1997.
