HomeMy WebLinkAbout3054 Transportation Functional PlanOrdinance 3054 Page 1 of 4 Ordinance No. 3054 AN ORDINANCE OF THE CITY OF PORT TOWNSEND ADOPTING A TRANSPORTATION FUNCTIONAL PLAN TO PROVIDE GUIDANCE ON TRANSPORTATION ISSUES THAT FACE THE CITY TO INCLUDE LONG TERM VEHICULAR CIRCULATION AND AMENDING CHAPTER 12.04 -TRANSPORTATION AND RIGHT-OF-WAY STANDARDS -AND CHAPTER 19.04 -STATE ENVIRONMENTAL POLICY ACT TO INCORPORATE THE PLAN INTO CITY STANDARDS AND ENVIRONMENTAL POLICIES. RECITALS: 1. The City of Port Townsend proposes to adopt a Transportation Functional Plan (TFP). The purpose of the TFP is to provide a measure of the current levels of transportation systems and guidance for the City to carry out its responsibilities for its transportation systems now and into the future. Adoption of the TFP includes along-range forecast of population and employment growth in the area and provides direction for prioritizing transportation improvements. It also includes program-level identification of specific potential improvements, such as roadway widening and extension projects, intersection projects, non-motorized improvements, and upgrades and maintenance to the existing transportation system. 2. The TFP has been developed in keeping with the established policies of the City's Comprehensive Plan and other approved plans such as the Non-Motorized Transportation Plan and the Gateway Plan. The TFP does not replace these existing plans, but is intended to augment the implementation of these plans into future City transportation projects. 3. In 2005 the City contracted with Larry Southwick, Southwick Enterprises, to develop a framework for the TFP. In 2006 the City contracted with the Transpo Group to provide the necessary transportation planning and traffic modeling experience needed for the TFP. 4. Upon initiation of the TFP development the City held a public Open House on November 7, 2007. Since then three City Council Workshops have been conducted as well as review of the draft TFP by the City Council's General Services and Finance Committees. 5. Adoption of the TFP was subject to environmental review and threshold determination in compliance with the State Environmental Policy Act (SEPA) (Chapter 43.21C RCW, and Chapter 197-11 WAC) and Chapter 19.04 PTMC. A Ordinance 3054 Page 2 of 4 Notice of Application and Intent to Issue a Determination ofNon-Significance (DNS) was published and provided to interested agencies on September 1, 2010. The public comment period ended on September 15, 2010. No written comments were received. On October 6, 2010, the City's SEPA Responsible Official issued the formal DNS on adoption of the TFP. No adverse impacts to the built or human environment were identified. 6. On October 14, 2010, the Planning Commission conducted a workshop on adoption of the TFP. A presentation was given by staff and the City's consultant on the TFP, Transpo Group, of Seattle, WA. Following questions asked of staff and the consultant, the Planning Commission directed staff to schedule and Notice a public hearing on adoption of the TFP. 7. On November 4, 2010, the Planning Commission held a duly noticed public hearing on the adoption of the TFP during which presentations were made by staff and testimony was sought from the public. At the conclusion of the public hearing the Planning Commission recommended adoption of the TFP. 8. The City Council finds that adoption of the TFP is consistent with the Transportation Element of the Comprehensive Plan, including the Non-Motorized Transportation Plan, and should be approved. NOW, THEREFORE, based upon the foregoing FINDINGS, and based upon the record before the Port Townsend Planning Commission and City Council, the City Council hereby ordains as follows: SECTION 1. ADOPTION. The Transportation Functional Plan is hereby adopted and recognized as partial implementation of the Transportation Element of the Comprehensive Plan. SEE ATTACHED EXHIBIT A SECTION 2. Chapter 12.04 -Transportation and Right-of--Way Standards of the Port Townsend Municipal Code is hereby amended to read as follows (text in underline is added): Article I. General Provisions 12.04.010 Intent -Findings. 12.04.020 Purpose -Authority. 12.04.030 Definitions. 12.04.040 Engineering design standards manual adopted -Purpose -Administration. 12.04.050 Gateway plan incorporated by reference. The Port Townsend Transportation Functional Plan is incorporated by reference and adopted as a part of this title as policy direction for guidance on long term vehicular circulation issues that face the City. SECTION 3. AMENDMENT. Chapter 19.02 -State Environmental Policy Act of the Port Townsend Municipal Code is hereby amended to read as follows (text in underline is added, section has been renumbered): 19.04.260 Substantive authority D. The city designates and adopts by reference the following policies as the basis for the city's exercise of authority pursuant to this section: 3. The city adopts by reference, and incorporates herein in their entirety, the following city plans, resolutions, ordinances, standards and codes as they now exist or may hereafter be amended, as SEPA policies: q. Port Townsend Transportation Functional Plan; r. All other city resolutions, ordinances, plans and guidelines effective now or after the date of the ordinance codified in this chapter. SECTION 5. Transmittal to Department of Commerce The City Clerk shall transmit a copy of this Ordinance to the State Department of Commerce within 10 days of adoption of this ordinance. SECTION 6. Severability. If any sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase or work of this ordinance. SECTION 7. Effective Date. This ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law.
