HomeMy WebLinkAbout2606 Amending Comprehensive Plan Land Use Map and Zoning MapOrdinance CITY OF PORT TOWNSEND, WASHINGTON AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN LAND USE MAP AND THE OFFICIAL ZONING MAP FOR THE CITY OF PORT TOWNSEND PURSUANT TO THE GROWTH MANAGEMENT ACT, CHAPTER 36.70A RCW, IN ACCORDANCE WITH PORT TOWNSEND COMPREHENSIVE PLAN POLICIES, AND ESTABLISHING AN EFFECTIVE DATE WHEREAS, the City of Port Townsend adopted its Comprehensive Plan in accordance with the Washington State Growth Management Act (GMA) on luly 15, 1996, Ordinance No. 2539. On April 7, 1997, by Ordinance No. 2571, the City of Port Townsend adopted a new Zoning Code and Official Zoning Map to implement the Comprehensive Plan. All findings, recitals and other provisions of Ordinance No. 2539 and Ordinance No. 2571, and all provisions of the Comprehensive Plan, are incorporated herein by this reference; and WHEREAS, the Port Townsend Comprehensive Plan contains goals, policies, implementing strategies and a Land Use Map intended to establish the character, quality and pattern of the future physical development of Port Townsend. The Plan specifies the amount and location of land for various land uses, and the density and intensity of development allowed. Important direction provided by the Plan, which is implemented through Title 17 PTMC, the Port Townsend Zoning Code, includes the designation of significant additional land for moderate and higher density multi-family development in order to encourage more diverse and affordable housing types (i. e., new R-III and R-IV designations); and WHEREAS, Chapter 20.04 PTMC sets forth criteria for the amendment of the Comprehensive Plan and the Zoning Code, enabling private property owners to seek amendments to the Comprehensive Plan Map and Zoning Map, with all such applications processed by the City on an annual basis; and WHEREAS, Blocks 177 and 178 of the Eisenbeis Addition, situated between 13th and 15th Streets, and between Rosecrans and McClellan Streets, were designated R-IV in the 1996 Comprehensive Plan Land Use Map and the 1997 Official Zoning Map of the City of Port Townsend; and WHEREAS, applicants Neil Cavette and Glen Norcross, with the permission of the other owners of Blocks 177 and 178 of the Eisenbeis Addition, have requested that the Land Use Map and Zoning designation of the property be changed from R-IV to an R-HI designation; and ORDINANCE AMENDING LAND USE & ZONING MAPS -1- Copied to Council oRD. NO. WHEREAS, pursuant to the State Environmental Policy Act, the Director of Building and Community Development issued a Determination of Non-Significance based upon the adoption of previous environmental review; and WHEREAS, the City has referred the proposed amendments to Jefferson County and to State Agencies for review and comment; and WHEREAS, the change in land use designation from R-IV to R-IH as proposed by the applicants, involves less that two acres of land, and would decrease the development potential of Blocks 177 and 178 but would not negatively impact the ability of the City to achieve its target growth management population level, in that the 1996 Comprehensive Plan designated 284 acres of land for multiple family development, when 139 acres would have been adequate to meet the City's population growth forecast. Further, adequate high-density multiple family (R-IV) zoned land will remain available to meet or exceed the Comprehensive Plan's goals and policies for a diversity of affordable housing types to serve the projected population; and WHEREAS, the 1996 designation of Blocks 177 and 178 for R-IV land use was based in part on the basis that these lots were vacant in 1996, without vested single family land development applications; and WHEREAS, information before the Plama. ing Commission when the land use designation was considered in 1996 may have been incomplete for Block 177 in that a building permit application was on file for a house that has now been completed; and WHEREAS, there is a changed circumstance for Block 178 in that single family infrastructure is scheduled to be installed that could serve single family homes on lots 1 through 4; and WHEREAS, neighbors have complained of inadequate infrastructure in the form of low water pressure and poor drainage in the general vicinity, with concern that these might be exacerbated by high density residential development; and WHEREAS, the Planning Commission held a properly noticed open record public hearing on the proposed amendments to the Land Use Map and Zoning Map on July 31, 1997, to consider public comment on the proposed action. The Commission recommended to City Council that the Maps be amended, making findings, conclusions and recommendations for Council consideration; and WItEREAS, the City Council held a properly noticed open record public hearing on September 15, 1997 to consider public comment based upon the Planning Commission's recommendations. The City Council has accepted the Planning Commission's recommended findings, conclusions and decision, which are incorporated herein by this reference. The City ORDINANCE AMENDING LAND USE & ZONING MAPS oRD. NO. Council has adopts the findings and recitals contained within this Ordinance in response to presentations and testimony presented, and all deliberations occurring at the Planning Commission and Council public hearings, NOW, TI~EREFORE, based upon the above findings and recitals, the City Council of the City of Port Townsend, Washington does ordain as follows: S~tion 1. Amendment of Land Use Map. Pursuant to the City's authority conferred by Chapter 35A.63 RCW, the City Council hereby amends the Comprehensive Plan Land Use Map for the City of Port Townsend, revising the R-IH and R-IV land use district boundaries as depicted on the attached map, which is marked as EXHIBIT A, attached hereto and by this reference made a part hereof. The Council hereby directs City staff to produce an amended Comprehensive Plan Land Use Map in accordance with EXHIBIT A. ~. Amendment of Official Zoning Map. Pursuant to the City's authority conferred by Chapter 35A.63 RCW, and in accordance with the GMA, Chapter 36.70A RCW, concurrently with the amendment of the Comprehensive Plan Land Use Map, the City Council hereby amends the Official Zoning Map for the City of Port Townsend, revising the R-III and R-IV zoning district boundaries as depicted on the attached map which is marked as EXHIBIT A, attached hereto and by this reference made a part hereof. The provisions of Title 17 PTMC shall continue to govern the administration, applicability, and interpretation of the Official Zoning Map. The Council hereby directs City staff to produce an amended Official Zoning Map in accordance with EXHIBIT A. ~ Filing. The amended Land Use Map and the amended Official Zoning Map shall be filed with the City Clerk and shall be available for public inspection upon the effective date of this Ordinance. ~ Transmittal to DCTED. The City Clerk shall transmit a copy of this Ordinance and the amended Maps to the State Department of Community, Trade and Economic Development (DCTED) within 10 days of adoption of this Ordinance. ~ Effect of Amended Land Use and Zoning Maps. Upon the effective date of this Ordinance, the previous Land Use Map (adopted pursuant to City Ordinance No. 2539 (1996)) amended by this Ordinance, and the previous Official Zoning Map (adopted pursuant to City Ordinance No. 2571 (1997)) shall be superseded by the amended Land Use Map, prepared in accordance with EXHIBIT A, and the amended Official Zoning Map, prepared in accordance with EXItIRIT A. However, if the amended Land Use Map and/or the amended Zoning Map adopted pursuant to this Ordinance are at any time hereafter declared to be invalid or of no effect, the previous Land Use Map and Official Zoning Map hereby amended shall spring into effect until subsequently amended or repealed. ORDINANCE AMENDING LAND USE & ZONING MAPS -3- oRD. NO. ~ Effective Date. This Ordinance shall be effective five days after its publication in accordance with Washington law. S~tlon 7. Severabillty. If any section, subsection, paragraph, sentence, clause or phrase of this Ordinance is declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portion of this Ordinance.
