AN ORDINANCE REGULATING AND LICENSING BICYCLES,
PROVIDING PROCEDURES AND ESTABLISHING PENALTIES
AND FEES.
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SEE$ION
ASSEMBLED, DO ORDAIN AS FOLLOWS:
Section 1. A bicycle is defined as any two wheeled vehicle, or
any unicycle, propelled by pedals, and nat required to be licensed
as a motor vehicle.
Section 2. It shall be unlawful to ~perate any bicycle on any
public right of way or in a public area without first obtaining
from the Chief of Police a bicycle license as hereinafter provided,
which license shall be evidenced by a tag at all times displayed on
said bicycle, and which tag shall be affixed to the bicycle by the
Chief of Police a~ the time the license is obtained.
Section 3. The Chief of Police is hereby authorized and directed
to issue, upon written application, bicycle licenses, which shall be
effective for one calendar year. The annual license fee to be paid
for each bicycle shall be one dollar. The initial license period
shall be from May 1, 1975 to May 1, 1976. Bicycles licensed under
the provisions of this ordinance shall be licensed from May 1st of
each year to the n~xt following May 1st, as aforesaid. The Chief of
Police shall affix a new license tab upon each bicycle at the time
of such licensing and relicensing.
Section 4. Bicycle licenses shall be transferable upon applic-
ation made to the Chief of Police, and upon payment of a transfer
fee of 50¢.

Section 5. Bicycles shall be operated on public rights of way
is compliance wi~h the rules of the road as set forth in RCW 46.61.750
through RCW 46.61.780, which stat~ statute is by this reference incorp-
orated herein and made a pa~t hereof, the same as though fully set out
herein.
Section 6. It shall be unlawful to ride any bicycle upon side-
walks along Water Street extending from Monroe Street to Harrison
Street; on Washington Street extending from Monroe Street to Taylor
Street; on Taylor Street extending from Washington Street to Front
Street; on Adams Street extending from Washington Street to Water
Street; on Quincy Street extend~gc'from Water Street t° Washington
Street and on Lawrence Street extending from Taylor Street to Harrison
Street.
Section 7. It shall be mn~awful for any parent or guardian to
authorize or abet the violation of this ordinance, or for any adult
to coumsel, advise or direct a minor child to violate this ordinance.
Section 8, It shall be unlawful to remove, deface, alter,mutilate
or destroy any bicycle license attached to a bicycle, or which has
been attached to a bicycle.
Section 9. Any bicycle found abandoned, unlicensed, or operated
in violation of the provisions of this ordinanCe or of state laws,
shall be impounded by the police department, and shall be returnable
only upon order of the Justice District Court, or other Court having
jurisdiction.
Section 10. Possession of a bicycle not licensed to the possessor
thereof shall ~onstitute prima facie evidence of wrongful possession
of said bicycle.
Section 11. The police department Shall provide forms for
applications, transfers and other transactions under the terms of
this ordinance, shall keep a record of licenses issued, to whom
issued, description of bicycle, license numbers, identifying
numbers, and such other records as maY be useful in the enforce-
ment of this ordinance.
Section 12. All funds collected under this ordinance shall
be remitted to the Current Expense Fund.
Read for the first time February 4,1975. Read for the second
and third times, Passed by the Council and approved by the Mayor on
February 18, 1975. ~~~
