HomeMy WebLinkAbout1737 Amending Ordinance 1138 - Garbage CollectionORD N CE NO. ;737 AN ORDINANCE AMENDING SECTIONS 4, 5, 6 AND 7 OF ORDINANCE NO. 1138. THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS: Section 1. Section 4 Ordinance No. 1138, passed in 1942, is hereby amended to read as follows: "Section 4. Permit to collect. It shall be unlawful for any one except '6ity employees to collect, remove', or transport garbage, offal, or any other offensive~or obnoxious substances or to operate any vehicle for such purpose through the streets, highways, or other ways, within the city wi%~out first having o~tained a permit from the city health officer; the permit shall be. numbered and be valid for one year, unless sooner revoked by the city health officer; Provided, however, that such service may be let by contract to others, in which ~ase the.contractor shall be sUbstituted for the Superintendmnt insofar as the terms of this ordinance provide." Section 2. Section 5 of Ordinance No. 1138 is hereby amended to read as follows: "Section 5. Collection Days. The duly authorized garbage collectors of the city shall remove garbage from each occupied dwelling house a~ least once a week; and from all other places as often as shall be found necessary, but not less than once a week. ~%11 places of business shall have their garbage removed as often as desired not to exceed once each day, and the amount to be paid there,fore shall bei'.in accordance with the number of times they are served per week. When garbage, ashes or rubbish have been collected as provided by ordinance, receptacles containing the same shall be pliced on the sidewalk or alley in the front or in the rear of the premises or other convenient place before seven-~hirty a.m. of the regular collection day, or when duly notifiedi.~y the proper authorities." Section 3. Section 6 of Ordinance NO. 1138,, as amended by Ordinance~No.~'i347, No. 1425, No. 1656, is hereby amended to read as follows: ~ "Section 6. Rates for Collection. The rate to be .charged for garbage' colle'~ion shall be Two Dollars and Seventy-Five Cents ($2.75) pe~.month for the collection of one can of garbage or rubbish per week, and said rate shall apply to each can .for which regular weekly collection is provided. For any can, or-equivalent of a can, of-~garbage or rubbish which is not collected on a regular weekly basis, the sum of Seventy-Five Cents (75¢) shall be charged for e~C~ col~ectiOn~ ~The~rates~herein"setTfo~ ~shall apply both to residential and commercial collections." 'Section 4. Section 7 of Ordinance No. 1138 as amende~ b~ Ordinance No. 1347, is hereby amended to read as follows: of the garbage department shall arrange the regular days for collecting of garbage during each week, and he shall fix the rate to be charged for such garbage collection according to the basic rate of Two Dollars and Seventy-Five Cents ($2.75) per month for the collection of each can of garbage per week. In commercial collections a monthly rate may be established based upon an average of cans collected each week. In case any difference between the superintendent of the garbage department and customer of the garbage department as to the number of garbage cans which should be provided and for which the customer should pay, the amount of charge fixed by the superintendent of the garbage department shall be final, subject to the right of the customer to appeal in writing the the City Council and to have a hearing and determination of any and all disputes or disagreements. Such appeals shall be by letter or other written communication. Owners o~ managers of all apartment houses shall provide the tenants thereof with adequate facilities and cans for the disposal of all garbage, rubbish and ashes, and the charge for such disposal shall be on the basis of the number of cans per week collected, provided, however, that nothing in the ordinance shall give any customer of the garbage department in the city~the right to demand any rebate or reduction in rate because a can or cans shall not be filled or used during any particular week, it being the intent of this chapter that each customer of the garbage department shall be charged on a monthly basis according to the number of cans ~ustomarily collected and shall pay an additional charge to be fixed by the superintendent of the garbage department for special loads."
