AN ORDINANCE OF THE CITY OF PORT TOWNSEND, AMENDING ORDINANCE
2820 AND EXTENDING THE ELECTRIC TRANSMISSION AND DISTRIBUTION
FRANCHISE TO PUGET SOUND ENERGY FOR UP TO THREE YEARS, UNDER ALL
TERMS AND CONDITIONS OF ORDINANCE N0.2820
WHEREAS, on December 16, 2002, at aregularly-scheduled City Council meeting, the
Port Townsend City Council adopted Ordinance No. 2820, extending Puget Sound Energy Inc.'s
(PSE's) electric transmission and distribution franchise in Port Townsend until December 31,
2010; and
WHEREAS, Puget Sound Energy representatives have requested of the City Manager an
additional extension of the existing franchise agreement, pending acquisition of certain PSE
facilities by Public Utility District No. 1 of Jefferson County (JPUD), which is expected to occur
within three years.
NOW, THEREFORE, the City Council of the City of Port Townsend ordains as follows:
SECTION 1. Franchise Agreement Extended. The electric transmission and
distribution franchise granted by Ordinance No. 2820 (December 16, 2002).to Puget Sound
Energy, Inc. is hereby amended to extend the term of the franchise to December 31, 2013 or the
closing of the acquisition of PSE assets by JPUD, whichever occurs earlier. With the exception
of the franchise term in Ordinance 2820, all terms and conditions of Ordinance No. 2820 are
reaffirmed without further amendment and are incorporated herein by this reference.
SECTION 2. Effective Date. This Ordinance shall take effect on January 1, 2011,
having been: (i) introduced to the City Council on September 20, 2010, more than five days
before its passage on October 4, 2010; (ii) first submitted to the City Attorney prior to September
20, 2010; (iii) published at least five days prior to the above-referenced effective date and as
otherwise required by law; and (iv) passed at a regular meeting of the City Council by at least a
majority on October 4, 2010.
SECTION 3. Severability. If any provision of this Ordinance or its application to any
person or circumstance is held invalid, the remainder of the Ordinance, or the application of the
provision to other persons or circumstances is not affected.
ADOPTED by the City Council of the City of Port Townsend at a regular meeting
thereof, held this 4th day of October 2010.
