Assessor's Tax Parcel Number: 951-902-601 Grantor: Grantee: Reference: City of Port Townsend Ordinance No. ~¢~,v Ordinance No. '~ ..5-'~, Auditor's File No. cj//~9_~ Zy~-~ WHEREAS, the City Council for the City of Port Townsend has considered Street Vacation Application No. LUP98-10 (Arthur Kamo), and following due notice has held a public hearing upon the application; and WHEREAS, the City Council for the City of Port Townsend adopted its Findings of Fact and Conclusions on May 4, 1998; and WHEREAS, the applicant has provided a warranty deed conveying a 40 foot road parallel to and directly west of the vacated alley in fee simple to the City of Port Townsend; and WHEREAS, the applicant has provided a current title insurance policy in a form acceptable to the City Attorney ensuring that the proposed 40-foot access to be conveyed to the City is owned in fee simple and free of all defects, liens, encumbrances, adverse claims or other matters; and WHEREAS, the applicant has complied with conditions of permit approval for Boundary Line Adjustment LUP97-00012 and Street Vacation application LUP96-00067 as modified by the Findings of Fact and Conclusions for Street Vacation Application No. LUP98-10; now therefore, JUL 2 { 19911! THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DOES ORDAIN AS FOLLOWS: Section 1. That the following alley is hereby vacated to Arthur Karno: The interior alley lying between Lots 6-10 and Lots 11-15 of Block 26 of the Fowler's Park Addition to the City of Port Townsend. Section 2. That the street vacation aforementioned is conditioned, however, on the following: A certified copy of the ordinance vacating the street shall be recorded by the City with the office of the Jefferson County Auditor. Section 3. This ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law, and after it has been recorded with the Jefferson County Auditor pursuant to Section 2 of this ordinance.
