A RESOLUTION AUTHOR/ZING THE MAYOR AND CITY
CLERK TO ENTER INTO AN AGREEMENT WITH THE
STATE DEPARTMENT OF TRANSPORTATION
WHEREAS, the state is contemplating the reconstruction of a portion of
State Route 20 and the installation of a new ferry terminal in Port Townsend;
and,
WHEREAS, in connection with the construction of the afOrementioned section
of highway, the State shall construct certain features; and,
WHEREAS, construction of this facility, will necessitate the transfer
of jurisdicti6n from the City to the State of certain City rights of way; and
WHEREAS, upon Completion of Construction of this facility, it iw necessary
to describe the division of responsibility of the State and the City in the
ownerships, maintenance and reconstruction of these features, and provide for
the transfer of rights, accordingly; now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND:
Section 1) That the Mayor be and he is hereby authorized and directed
to enter into and execute an agreement with the State of Washington, Department
of Transportation deeding all City rights of way needed for the Construction
of this facility to the State and agreeing to accept jurisdiction to said
features subsequent to the completion of construction and opening to public
use relieving the State from all responsibilities in the operation maintenance,
and reconstruction of these features.
