HomeMy WebLinkAbout82-009RESO ,UTION ¢'x-7 A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO A FURTHER AGREEMENT WITH THE STATE OF WASHINGTON DEPARTMENT OF TRANS- PORTATION. WHEREAS, the State is contemplating the reconstruction of a portion of State Route 20 and the installation of a new ferry terminal access at aproxi- mate milepost 12.51; and, WHEREAS, the State will reimburse the City the cost of transplanting certain trees; and WHEREAS, the City will reimburse the State for installation of a portion of the City's illumination system on State Route 20; and, WHEREAS, it is deemed by the State and the City to be in the best public interest to enter into an agreement for the State and the City to perform the work set forth, NOW, THEREFORE, BE IT RESOLVED BY THE THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND: Section 1. That the Mayor be and he is hereby authorized and directed to enter into and execute an agreement with the State of Washington Department of Transportation as described in Exhibit "A" attached hereto as though fully setforth herein. NOW THEREFO,~, in consideration of the items, conditions, covenants, and performances set forth belc~v or attached and incorporated and made a part hereof, IT IS MUTUAl LY AGP~W) T~T: -1- I GENERAL CONDITIONS The State and the City each accept as their portion of the ferry terminal access project those items listed herein as 'W~)RK BY STATE" and "W~ BY CITY,. The City agrees to permit the State or the States representative to enter upon ihe City's property to perform any and all work necessary to the const- ruction set forth in this agreement. II WORK BY STATE The State shall design, prepare plans, specifications, cost estimate and advertise for bids, a~ird and administer a contract for construction of a ferry term,~nal access on the south side of State Route 20, approximate milepost 12.51, as shown on the plan attached hereto as Exhibit "A" and by this reference made a part of this agreement. The State shall include in the contract, luminaire base block-outs and under- ground installation of Ci~ty furnished one-inch diameter galvanized conduit for a portion of the City's illumination ~ystem. The cost to the City for this portion of the City's ill~mination system is shown on Exhibit "B" attached hereto and by this reference made a part of this agreement. III WORK BY CITY The City will remove approximately twenty (20) maple~ trees frem the right of way of State Route 20. The cost for removing these trees is shc~vn on Exhibit "C" attached hereto and by this reference made a part of this agreement. GC6848 Upon removal of the trees from the State right of way the City will assume all responsibility for said trees. It is intended that all the work involved in the removal of these trees shall be accanplished by April 30, 1982. The State upon completion of the work mentioned in Section II paragraph two of this agreement, will bill the City for the lump sum anount of Seven Hundred Dollars ($700.00) as Shown on Exhibit "B". The City will reimburse the State the amount of such billing not later than thirty (30) days following its receipt. If payment has not been received within the time set forth above, the State may withold from any tax monies which the City is entitled to receive frc~u the ~tor Vehicle Fund such amount as is necessary to satisfy the billing. The City upon completion of the work n~ntioned in Section III of this agreement 'will bill the State for the Lump Sum amount of Three Thousand Dollars ($3,000.00) as shown on Exhibit "C". The State will reimburse the City the amount of such billing not later than thirty (30) days following its receipt. Ail projects in ~apport of all costs incurred and actual expenditures by the City are to be mintained in accordance with procedures prescribed by the State Auditors Office. The records shall he opened to inspection at all reasonable times and shall be retained and made available for inspection for a period of not less than three (3) years from the final payment of any State funds to the City. Copies of said records shall be furnished to the State upon request. V It is further provided that no liability shall attach to the State or the City by reason of entering into this agTeen~nt except as exloressly provided herein.
