A RESOLUTION AUTHORIZING THE MAYOR AND CLERK OF
THE CITY TO EXECUTE AN AGREEMENT FOR THE CONDI-
TIONAL PURCHASE OF PROPERTY FOR KAH TAI PARK
WHEREAS, The City of Port Townsend has undertaken to
establish and construct a public park at and near the property
commonly known as the Kah Tai Lagoon within the City limits,
and have acquired property for such purposes with the aid of
State funds, and
WHEREAS, the City desires to obtain property owned by
the Estate of Mrs. T. H. Baker, Sr., and her legal heirs, for
such purposes on certain conditions, now therefore
BE IT RESOLVED, that the Mayor and the Clerk of the City
of Port Townsend are hereby authorized and directed to execute
and enter into the attached AGREEMENT for the conditional
purchase of real property from the Estate of Mrs. T. H. Baker, Sr.,
and her legal heirs, for the sum of $400.00, which funds are to
be provided by State funding and which, if not available or not
paid to the Estate or said heirs within one year from the date
of said contract, the property shall be reconveyed to the heirs
with no liability to the parties whatsoever, or in the event that
unknown heirs of the estate claim an interest in said property and
do not agree to convey their interest therein for a prorate share
of said $400.00, then the City may at its option also reconvey
the property to said heirs with no 'liability to the parties what-
soever.
