A RESOLUTION AUTHORIZING AN AGREEMENT WITH TOWNE
POINT PUD TO MAINTAIN SANITARY SEWER SYSTEM
BE IT RESOLEVED by the City Council of the City of
Port Townsend, that the Mayor is a~thorized and directed
to enter into and execute the attached contract with Towne
Point PUD providing for the maintenance of the sanitary
sewers of the Towne Point PUD upon payment of all costs
therefore incurred by the City, and providing for prior
deposit of funds to cover said costs.
Approved and Passed by the City Council and signed
by the Mayor for the City this ~day of January, 1985.

CITY - TOWNE POINT P.U.D. AGREEMENT
The City of Port Townsend (City) agrees to perform maintenan6e .
work on the sanitary sewers within the Towne Point P.~3.D., as
requested by ~lr. Robert F. Sahli, and Mr. Sahli agrees to pay
for such work at actual cost to the City, including but not
limited to costs for labor, fringe: benefits, overhead, aaminis-
tration and material. Equipment rental for City-owned equipment
will be based on the 34th - 1983 Edition of "Rental Rates
Compilation' as compiled by the Associated Equipment Distribution.
The undersigned further agrees to provide all easements, permits,
rights of way and to protect the City of Port Townsend and save
it harm]ess from all claims for damages auainst the City which
may result from said work, except actual negligence by the
City affecting the desired work.
Maintenance work requested shall be schedulea into the City work-·
load by the Public Works Director-
This agreement shall be renogotiated each year on ~he anniversary
date. Partner signing below warrants he has authority to sign this
agreement.
The City shall require,prior to commencement of any work, a cash
deposit from Towne Point in an amount estimated by the City Public
Works Director to cover all costs under this agreement of work to
be performed. If the costs actually are less then the deposit,
the City shall return any excess funds to Towne Point until such
time as additional work is requested or required, in which event
Towne Point shall on demand of the City remit additional funds.
If the deposited funds are less than needed to pay actual costs,
the City may require an additional deposit in advance before com-
mencing or completing the work. In the event any work is performed
by the Cit~ which has not been paid for by Towne Point in advance,
Towne Point shall promptly pay ~he cost of said work to the City
within thirty (30) days of billing by the City.
