HomeMy WebLinkAbout85-007RESOLUTION ~ 85-~ RESOLUTION AUTHORIZING AND DIRECTING THE CITY TO ENTER INTO A WATER SUPPLY CONTRACT AND A WATER RIGHTS AGREEMENT WITH THE JEFFERSON COUNTY PUBLIC UTILITY DISTRICT ~1. WHEREAS, the Jefferson County Public Utility District #1 proposes to design, construct, maintain and operate a public water system in the area commonly known as the North and South Hastings Loop, and desires to purchhse water from the City wholesale for the purposes of using such water for said system, and WHEREAS, the City of Port Townsend has excess supply of water available for the wholesale sale to the PUD for provision of a public water system, and WHEREAS, Jefferson County Public Utility District #1 has ob- tained a preliminary permit to study the feasibility of a hydro- electric project on the Big Quilcene River, and has undertaken feasibility studies with respect to such proposed project, and has represented that if such project proceeds to design, construction, maintenance and operation, the City of Port Townsend's water, water rights and water system will not be hindered, affected or otherwise deminished by reason of said hydro-electric project, and WHEREAS, the City desires a written agreement providing that the City's water system and-water rights on the Big Quilcene River will not be affected by said project in any way or manner, and that the Jefferson County Public Utility District #1 affirmatively request of the Federal Engery Regulatory Commission that the same be a con- dition of any license issued to it or anyother co,applicant for such license, including--a condition that eminent domain will not be exercised by the PUD to acquire or purchase any of said assets of the City, therefore jBe at resolved, that the Mayor and the Clerk of the City are here and hereby authorized and directed to execute the attached agreements on behalf of the City, by and between the City of Port Townsend and Jefferson County Public Utility Distri6t #1, which agreements pro- vide for the wholesale sale of water to the PUD for the North and South Hastings Loop Water Systems proposed to be constructed and operated by the PUD, and the attached agreement providing that the PUD will not hinder, affect or deminish any part of the City's water rights or water system by reason of its proposed hydro-electric pro- ject and will request that a condition be made and approved by the Federal Energy Regulatory Commission of any license applied for or obtained by the PUD that the same will not occurs and the Mayor and the Clerk of the City are authorized to execute on behalf of the City said agreements upon them both being signed and duly executed by the Jefferson County Public Utility District ~1 and approved by the Mayor and City Attorney for the City of Port Townsend.
