A RESOLUTION AUTHORIZING THE CITY TO EXECUTE AN
AGREEMENT WITH SEAVIEW ESTATE LANDOWNERS FOR THE
CONTRIBUTIONS TO COSTS FOR A LOCAL IMPROVEMENT
DISTRICT SEWER PROJECT.
WHEREAS certain landowners at Seaview Estates have indicated
that they desire to create a local improvement district for the
purposes of designing, constructing and maintaining a public sewer
system within the Seaview Estates, and
WHEREAS the city is not able to contribute and advance the funds
for preliminary costs of such a local improvement district, but the
certain landowners of Seaview Estates are willing to help contribute
to said costs, and
WHEREAS, if the project is designed, developed, constructed and
begins operation, the contributions of the landowners should be
credited against future assessments against them, but if for any
reason the City desires or is unable to proceed with the local
improvement district, the-funds of both the landowners and the City
will not be reimbursed, now therefore,
BE IT RESOLVED, that the Mayor and the City Clerk be and they
are hereby authorized and directed to execute agreements in the
form of the attached agreement, with various landowners of Seaview
Estates who contribute funds for this purpose, upon the individual
landowners and their spouses executing said agreements and paying
the funds to the City Treasurer as provided in said agreement. It
is further understood that if the project and local improvement
district proceed and are completed, the landowners will receive
credit against future assessments in the amounts contributed under
these agreements, but if for any reason whatsoever the local

improvement district and sewer system are not proceeded with and
completed, then the landowners will not be entitled to receive
any reimbursement of the funds contributed by them.
