A RESOLUTION AUTHORIZING THE MAYOR AND CLERK OF THE CITY
OF PORT TOWNSEND TO EXECUTE A CONTRACT WITH THE DEVELOPERS
OF ISLAND VISTA TO PROVIDE SEWER~SYSTEM MAINTENANCE AND
REPAIR ON A LABOR/TIME AND MATERIALS PAYMENT BASIS
WHEREAS, the plat of Island Vista is located beyond the
limits of the ~City of Port Townsend and the various owners
and the present developer of the plat may seek to petition
for annexation to the City of Port Townsend, and
WHEREAS, there is presently no corporate or public entity
responsible for the maintenance and repair of the sanitary
sewer system for the plat, which includes the lines up to
individual lot connections, pump, pump station and accessories,
and
WHEREAS the developer and the City are willing to enter
into a temporary agreement for the repair and maintenance of
the sanitary sewer system on certain terms and cOnditions on
an annual basis or until the plat is annexed to the City, now
therefore -~
BE IT RESOLVEDi~that the Mayor and the Clerk o~ the City
are here,and hereby authorized to negotiate and execute an
agreement with the present developer of the Island Vista Plat
for the repair and maintenance of the sanitary sewer system
serving the plat, to include the following terms:
(1) The City shall inspect the pump and pump station daily.
(2) The City shall repair and maintain the main lines up
to individual lot connections, and the pump and pump station.
(3) The City shall be paid in advance the cost of all labor
and materials to perform the agreement.
(4) A fund shall be established in advance in the amount
of $1,000.00 from which to pay for labor and materials, and said
fund shall not be depleted below that amount, and any additional
work which may cost more than the amount of the fund shall be
paid in advance based upon City Engineer estimates.
(5) A similar fund shall be established in the amount of
$1,500.00 to cover the cost of repair or replacement of the
pump.
(6) Charges shall be the normal charges incurred by the
City.
(7) The agreement shall be for a term of one year, or
until the plat is annexed by the City, whichever shall occur
first. The agreement shall be renewable thereafter for one
year terms upon the agreement of the City and the developer.
(8) The City shall be allowed to terminate the agreement
in the event of nonpayment by the developer.
(9) The City shall not be responsible to service any
area beyond the Island Vista Plat.
ApProved and passed by the City Council for the City of
Port Townsend and signed by the Mayor this 16th day of July,
1985.
