HomeMy WebLinkAbout87-065BRESOLUTION NO. ~7-~ A RESOLUTION of the City Council of Port Townsend, Washington, declaring the intention of the Council to order the formation of a local improvement district for the construction and installation of additions and betterments to the sewer system of the City applicable to and covering the area within the boundaries of said proposed local improvement district; setting forth the nature and territorial extent of such proposed improvements; designating the number of the local improvement district; describing the boundaries thereof; stating the estimated cost and expense of the improvements and the amount thereof proposed to be borne by the property within the proposed local improvement district; and fixing a date, time and place for a public hearing on the formation of the proposed local district. WHEREAS, the City Council of the City of Port Townsend, Washington (herein referred to as the "City"), has determined that it is necessary to providing for additions and betterments to the portion of the system of water and sewer for the City, in the Northwest area of the City; and WHEREAS, the City now desires to proceed with the carrying out of a portion of said improvements and to establish a local improvement district in connection therewith; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, WASHINGTON, as follows: Section 1. It is the intention of the Council to order the improvement of the area within the City described in Exhibit A attached hereto and incorporated herein by this reference, by the acquisition, construction and installation of the following improvements: A sanitary sewer line, either 10" or 8" including manholes, as follows: In 49th Street between Sheridan and Hendricks Streets; Northwester- ly in 49th Street a distance of approximately 200 feet; in a Southwesterly direction across unplatted land to Rosecrans Street betw~.~en Blocks 20 and 21, Taccma Addition; South in Rosecrans to 45th Street; West in 45th Street to Thcmas Streets North in Thc~as Street to East Sapphire Street; West in East Sapphire Street to ~nerald Street; Southwesterly in Emerald Street to Pearry Street; Such improvements shall be installed complete with all auxiliary valves, fittings, equipment and appurtenances necessary to the proper operation of the water and sewer system of the City. Section 2. The City shall acquire by gift, purchase, fran- chise, lease or condemnation all property, both real and personal, or any interest therein and all rights of way, franchises, permits and easements which may be found necessary to acquire, construct, and install the above-described improvements. Section 3. It is hereby further provided that the herein- before authorized plan of improvements shall be subject to such changes as to details of said plan, not affecting the service to be provided by the plan of improvements, as shall be authorized by the Council either prior to or during the actual course of construction. Section 4. Said proposed local improvement district shall be designated "Local Improvement District No. 1 " The cost of the improvements described in Section 1 shall be assessed against the property specially benefited by such improvements, on the basis of the amount of the special benefits to such property. The assessments shall be for the sole purpose of payment into such local improvement district bond fund as may be specified by the City Council for the payment of local improvement district bonds to be issued in part to defray the costs of such improvements. Section 5. All persons who may desire to object to such improvements and the formation of a local improvement district are hereby notified to appear and present such objections at the meeting of the City Council to be held in the Council Chambers of the City Hall at Port Townsend, Washington, at 8:00 p.m. on November 17 , 1987, which time and place are hereby fixed for hearing all matters relating to said proposed improvements and all said improvements. The City Clerk is hereby directed to give notice of said hearing in the manner required by law, with the date of the first publication to be at least fifteen days prior to the date of said hearing, and to mail a notice of such hearing setting forth the nature of the proposed improvements, the total estimated cost including the amount thereof to be borne by the City, the estimated benefits of the improvements to the particular lot, tract or parcel of land, the time and date of said hearing, at least fifteen days before the date thereof, to each owner or reputed owner of any lot, tract, parcel of land, or other property specially benefitted by said improvements, at the address shown on the tax rolls of the County Assessor. ATTEST: City Clerk APP~VED AS ,~ FORM: EXHIBIT B NOTICE OF ADOPTION OF RESOLUTION OF INTENTION TO CREATE AND NOTICE OF HEARING ON CREATION OF LOCAL IMPROVEMENT DISTRICT NO. 1 YOU ARE NOTIFIED that on October 20 , 1987, the City Council of Port Townsend, Washington (t~ 'n-~i~trict"), adopted Resolution No. 87-65 declaring its intention to create Local Improvement District ("LID") No. 1 and to order the construction of certain improvements to the water and sewer system of the City within said LID No. 1 The boundaries of the proposed LID are as set forth in that resolution. The proposed improvements consist of a sardtal-y sewer line, either 10 inches or 8 inches or a ccmbination of both, including manholes, auxiliary valves, fittings, equipment and apurtenances necessary to the property operation of the water and sewer system of the City, approximately in the areas described below on the bottc~ of this notice.* The estimated cost of these improvements, and other expenses in connection with the improvements, is $ 473,312.00 of which $ 473,312.00 shall be paid by special assessments levied against the property within the proposed LID specially benefited by the proposed improvements. You are notified that a meeting of the City Council will be held at City Mall, City Council Chambers, 540 Water Street, Port Townsend, at 8:00 p.m., on November 17, ]987, which time and place are fixed for hearing of matters relating to such formation and improvements and for determining the method of payment thereof. Persons desiring to object to the improvements and the formation of the proposed LID must file written protests against such improvements and formation signed by the owner of property within the proposed distr~ct, identified with the property parcel number or the property description or otherwise clearly identifying the property, with David Grove, City Clerk, 540 Water Street, Port Townsend, Washington 98368, prior to the time of the above-mentioned LID formation hearing, and may also appear at the hearing to state their views.
