A RESOLUTION AUTHORIZING EXECUTION OF SETTLEMENT
AGREEMENT RE UNION WHARF SHORELINE HEARINGS BOARD
APPEAL
WHEREAS, the City of Port Townsend previously granted to
Union Wharf Associates a shoreline substantial development
permit for the development of Union Wharf within the City of
Port Townsend, and
WHEREAS, the Department of Ecology for the State of
Washington refused to accept said permit, and Union Wharf
Associates appealed the decision of the Department to the
Shoreline Hearings Board for the State of Washington, and
WHEREAS, the City of Port Townsend is a party to said
appeal together with Jefferson County, Union Wharf Associates,
and the Department of Ecology, and
WHEREAS, the parties have agreed upon settlement of the
appeal, in accordance with the terms of that certain settle-
ment agreement which is attached hereto and by reference made
a part hereof as if set forth in full, now therefore,
BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF PORT
TOWNSEND THAT THE CITY ATTORNEY FOR THE CITY OF PORT TOWNSEND
BE AND HE IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE THE
ANNEXED SETTLEMENT AGREEMENT ON BEHALF OF THE CITY, IN SUB-
STANTIALLY THE FORM ATTACHED HERETO, AND TO EXECUTE ANY AND
ALL DOCUMENTS NECESSARY TO CARRY OUT THE TERMS THEREOF.
Passed by the City Council for the City of Port Townsend
and signed and approved by the Mayor for the City on April 5,
1988.
