AN ORDINANCE OF THE CITY OF PORT TOWNSEND CREATING A NEW
SECTION 3.36.070, STREET VENDOR APPLICATION AND LICENSE FEES,
CHAPTER 3.:36, PERMIT, APPLICATION AND APPEAL FEES, TO REINSTATE
FEES THAT WERE INADVERTENTLY DELETED FROM SUBSECTIONS 5.32.050B
AND 5.32.070K OF THE PORT TOWNSEND MUNICIPAL CODE
WltE~S, pursuant to Chapter 5.32 PTMC, the City issues licenses to street vendors, as
defined by that code chapter; and
WHEREAS, the City has taken steps to reform its code by removing various license fees
from substamive code sections, and consolidating such fees within Chapter 3.36 PTMC; and
WltEREAS, in revising Chapter 5.32 PTMC, the City inadvertently deleted the fee for street
vendor licenses from that chapter of the code, without adding the fee into Chapter 3.36 PTMC; and
WHEREAS, this ordinance corrects the inadvertent error of failing to recodify the fee for
street vendor licenses, by creating a new section denoting the fees,
NOW, THEREFORE, the City Council of the City of Port Townsend does ordain as
follows:
SECTION 1. A new Section, 3.36.070, Street Vendor Application and License Fees,
Chapter 3.36 Permit, Application and Appeal Fees of the Port Townsend Municipal Code is hereby
adopted and shall read as follows:
3.36.070 Fees - Street Vendor Application and License.
The application fee for street vendor licenses issued in accordance with PTMC ChaPter 5.32 (Sales
on Streets and Sidewalks) shall be $50.00 The annual street vendor license fee required pursuant to
Chapter 5.32 PTMC shall be $350.00.
SECTION 2. Severability. If any provision of this ordinance or its application to any person
or circumstance is held invalid, the remainder of the ordinance, or the application of the provision to
other persons or circumstances is not affected.
This ordinance shall take effect and be in force five days after the date of its publication in the
manner provided by law.
Adopted by the City Council of the City of Port Townsend, Washington, at a regular meeting
