A RESOLUTION OF THE CITY COUNCIL OF. THE CITY
OF PORT TOWNSEND, AUTHORIZING A LATECOMER
UTILITY CONTRACT PURSUANT TO RCW 35.91.
WHEREAS, Larry W. Lammers. has agreed to construct a 8-inch
sewer line in the alley between Hill Street and Jackman Street
from 14th Street to 12th Street within the City of Port Townsena
in Jefferson County, Washington, and
WHEREAS, Larry W. Lammers wishes to enter into an Agreement with
the City of Port Townsend pursuant to RCW 35.91, as amended, to
provide for payment of the costs of such improvement, and for
partial reimbursement by subsequent users or connectors to the
system,
NOW THEREFORE, be it resolved by the City Council of the City
of Port Townsend that the Mayor is hereby authorized to execute on
behalf of the City an agreement substantially in the form of
Exhibit 1, attached hereto, providing for the payment of the costs
of construction of the utility line by the person set forth
therein, and for such person to be reimbursed by subsequent users
or connectors onto said utility line, in the amounts and in the
time and manner set forth therein.
