HomeMy WebLinkAbout89-093RESOLUTION NO. 89-93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND AUTHORIZING ACCEPTANCE OF A SANITARY SEWER EASEMENT AND THE PAYMENT OF CONSIDERATION THEREFOR IN CONNECTION WITH SEWER LID NO. 1, AND RESCINDING RESO- LUTION NO. 89-47 WHEREAS, the City Council for the City of Port Townsend has pre- viously created Local Improvement District No. ] for the establishment, construction and financing of a sewer system in the Northeast portion of the City in and around the Seaview Estates vicinity, and WHEREAS, a sanitary sewer easement is necessary over certain real property in the vicinity for the laying, construction and operation of sewer lines in connection with the system, and WHEREAS, the City has negotiated the purchase of such a sanitary s'ewe~, easement from the property owner described below, and WHEREAS, the City previously passed Resolution No. 89-47, and the terms approved therein have now been modified and therefore the City desires to rescind said Resolution, now, therefore~ BE IT RESOLVED, that the Mayor and Clerk of the City be and are hereby authorized to execute upon behalf of the City of Port Townsend the attached Exhibit A, Sanitary Sewer Easement, and any other docu- ments necessary to accept said easement from the owners named therein and to carry out the terms of this Resolution, providing for the granting of an easement to the City of Port Townsend by Albert L. Levinski, Executor of the Estate of Henry C. Levinski, Sr., deceased, and providing for other terms and conditions thereof, on the real property described in such Sanitary Sewer Easement, which is by this reference incorporated herein as is set forth in full. BE IT FURTHER RESOLVED, that the City Clerk be and is hereby authorized to issue the City's warrant or warrants in the amount of $4,000.00, to be paid to Albert L. Levinski, Executor of the Estate of Henry C. Levinski, Sr., deceased, for and as the consideration for said easement, and the City Council for the City of Port Townsend agrees to pay said consideration for the easement, provided, however, that the easement shall become null and void if construction is not substantially completed on or before January 1, 2000. BE IT FURTHER RESOLVED, that Resolution 89-47, passed by the City Council on July 18, 1989, be and the same is hereby rescinded.
