A RESOLUTION AUTHORIZING THE MAYOR AND CLERK OF THE
CITY TO EXECUTE AN ENGINEERING AGREEMENT WITH NTI
AND DECLARING AN EMERGENCY
WHEREAS, the Public Works Director/Engineer for the City of
Port Townsend has resigned his position effective March 31, 1990;
and
WHEREAS, the City is without an Engineer at the present time
but foresees a need for periodic engineering services for the
next several weeks; and
k~EREAS, the selection process for a new Public Works Direc-
tor/Engineer has unexpectedly been delayed and taken more time
than anticipated so that such position may not be filled for the
next several weeks; and
WHEREAS, as a result an emergency exists pursuant to RCW
39.80.060 for a short-term period which requires the immediate
execution of the work proposed in an agreement with Northwest
Territories, Inc. (NTI), a copy of which zs attached hereto and
by this reference made a part hereof; and
WHEREAS, the City Council of the City of Port Townsend finds
and declares such an emergency in view of pending projects and
the anticipated need for immediate short-term engineering services,
now, therefore,
BE IT P~SOLVED by the City Council for the City of Port Town-
send that the Mayor and City Clerk be authorized and are hereby
authorized to execute on behalf of the City the attached engi-
neering agreement with NTI, with the addition of such automobile
and professional liability insurance requirements, if any, and a
hold harmless and indemnity provision in favor of the City, with
limits and coverage and in form and substance acceptable to the
Mayor and City Attorney.
BE IT FURTHER RESOLVED that an emergency exists pursuant to
RCW 39.80 and that the provisions of RCW 39.80 shall therefore
not apply.
PASSED AND APPROVED by the City Council for the City of Port
Townsend and signed by the Mayor for the City this 3rd day of
April, 1990.
