A RESOLUTION AUTHORIZING THE CITY OF PORT TOW~-
SEND TO RECEIVE TITLE AND CONTRIBUTE FUNDS TO
THE PURCHASE OF CERTAIN REAL PROPERTY WITHIN THE
CITY FOR CITY PARK PURPOSES, AND AUTHORIZING THE
CITY TREASURER TO DISBURSE FUNDS THEREFOR; AND
AUTHORIZING THE MAYOR AND CLERK OF THE CITY TO
EXECUTE DOCENTS NECESSARY TO CLOSE THE TRANS-
ACTION
WHEREAS, Alain DeChantal and Judith DeChantal own the following
described real property within the City of Port Townsend:
Ail that portion of Lots 5 and 7, Block 69 of L. B. Hasting's
Second Addition to Port Townsend, as per plat recored in Volume 1 of
Plats, page 29, records of Jefferson County, Washington, lying South-
erly of the right-of-way of State Road No. 9 (S. R. 20, also known
as Sims Way); except that portion, if any, deeded for railroad right-
of-way by deed recorded March 27, 1928, under Auditor's File No.
57878, records of Jefferson County, Washington; situate in the City
of Port Townsend, Jefferson County, Washington.
WHEREAS, the City of Port Townsend desires to purchase said
property, in conjunction with the Jefferson County Land Trust, pur-
suant to the terms of a Real Estate Purchase and Sale Agreement
dated May 4, 1990, between Jefferson County Land Trust, a Washington
State Non-Profit Corporation, as Purchaser, and Alain DeChantal and
Judith DeChantal, as Seller; and
WHEREAS, the City's financial contribution toward the purchase
price and costs of sale shall not exceed the amount of
and
WHEREAS, the City desires to obtain said property for City
park purposes only and is to receive title to the same by agreement
with the Jefferson County Land Trust, now, therefore,
BE IT RESOLVED by the City Council for the City of Port Town-
send that the Mayor and the City Clerk for the City are here and
hereby authorized and directed to execute any and all documents on
behalf of the City of Port Townsend necessary for the City to acquire
title to the above-described property.
BE IT FURTHER RESOLVED that the City of Port Townsend shall ac-
quire said property for City park purposes.

BE IT FURTHER RESOLVED that the City's total financial contrib-
ution toward the Purchase and Sale, including the City's total con-
tribution toward the purchase price therefor, shall not exceed the
sum of $
BE IT FURTHER RESOLVED that the City Treasurer is here and
hereby authorized and directed to issue and disburse the City's war-
rant or warrants for said purposes in an amount not to exceed
BE IT FURTHER RESOLVED that the Purchase and Sale shall be in
accordance with the terms of that certain Real Estate Purchase and
Sale Agreement dated May 4, 1990, which is attached hereto as Ex-
hibit 1 and by this reference incorporated herein as if sen forth
in full.
PASSED by the City Council for the City of Port Townsend and
signed by the Mayor of the City this lgr~ day of May, 1990.
