HomeMy WebLinkAbout3034A Interim Regulations - Overlay/Special Height Overlay District ZoningOsdinance 3034A Interim Height Overlay PaKel oft Ordinance No. 3034A AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, WASHINGTON, EXTENDING INTERIM REGULATIONS ADOPTED IN ORDINANCE 3022 TO ADDRESS A CONFLICT BETWEEN CHAPTERS 17.26 - OVERLAY DISTRICT AND 17.28 -SPECIAL HEIGHT OVERLAY DISTRICT REGARDING THE HEIGHT LIMITATIONS ON A BLOCK OF LAND ZONED FOR R- II RESIDENTIAL (BLOCK 100 OF THE PORT TOWNSEND ORIGINAL TOWNSITE) RECITALS: A. Council adopted interim regulations by Ordinance 2992 on October 3, 2008, and held a public hearing on the matter on November 17, 2008. By Ordinance 3008 (ll~larch 16, 2009), Council re-enacted and extended Ordinance 2992 to provide additional time to address the issue and for Planning Commission review to occur. By Ordinance 3022 (September 7, 2009), Council re-enacted and extended Ordinance 3008 to provide additional time to address the issue and for Planning Commission review to occur. Council is considering adoption of draft Ordinance 3034 on March 1, 2010. If adopted, Ordinance 3034, once effective, would provide final regulations and end the need for interim regulations. Because draft Ordinance 3034, if adopted March 1, would not be effective until mid-March or later (5 days after passage and publication), Council determines to adopt an ordinance that extends the interim regulations for the short period of time to allow for any further consideration Ordinance 3034 and before Ordinance 3034 becomes effective. B. The City Council affirms the recitals in draft Ordinance 3022 (providing fox interim regulations). C. RCW 35A.63.220 relating to Code cities like Port Townsend and 36.70A.390, a section of the Growth Management Act (Ch. 36.70), authorizes the City to adopt interim regulations to preserve the status quo while new plans or regulations are considered and prepared. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, WASHINGTON, ORDAINS AS FOLLOWS: SECTION A. Extension of Ordinance 3022. For the reason set forth in the Recitals in Ordinance 3022, which axe approved, those provisions in Ordinance 3022 are hereby re- imposed, re-enacted, extended and continued in existence for six months for the effective date of this Ordinance or until regulations relating to height limits are adopted by the Ciry Council, whichever is sooner. SECTION B. Severabilitv. ff any sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or Ordirzarace 303A~ Interim HeigJ~t Overlay Page 2 of 2 unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase or work of this ordinance. SECTION C. Effective Date. This Ordinance shall take effect immediately after passage if adopted by a majority plus one of the City Council, and this ordinance shall thereby be designated as a public emergency ordinance necessazy for the protection of the public health, safety. property and welfare. Otherwise this ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law. Publication of this ordinance shall be by summary thereof consisting of the title.
