HomeMy WebLinkAbout2727 Regulations and Fees for Use of Pope Marine Building, Chetzemoka Park and Union Wharf FacilitiesOrdinance No. 2727 AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING SECTION 3.38.020, CHETZEMOKA PARK FACILITY FEES - PERMITS. INSURANCE, AND SECTION 3.37.20, POPE MARINE BUILDING FEES, AND SECTION 5.46.210, UNION WHARF OUTBOARD SIDE OF UNION WHARF - PERMITTED ACTIVITIES, OF THE PORT TOWNSEND MUNICIPAL CODE. WHEREAS, on March 16, 1998 the City Council adopted Ordinance 2631 at a regularly scheduled Council meeting, whereby Chapter 5.46, City Dock and Union Wharf Use Regulations and Charges were modified to reflect a higher percentage of actual costs; and WHEREAS, when Ordinance 2631 was adopted, amending Ordinance 2603, the City estimated an increase in the cost to certain charges for City Dock and Union Wharf in Port Townsend Municipal Code, Section 1, Chapter 5.46; and WHEREAS, the City now has updated information and experience upon which to base charges for these services at City Dock and Union Wharf; and WltEREAS, on January 16, 1996, the City Council adopted Ordinance 2502 at a regularly scheduled Council meeting, whereby Chapter 3.38, Chetzemoka Park Facility Use fees were modified to reflect a higher percentage of actual costs; and WHEREAS, on March 2, 1994~ the City Council adopted Ordinance 2403 at a regularly scheduled Council meeting, whereby Chapter 3.37, Pope Marine Building Use Regulations and Charges were modified to reflect a higher percentage of actual costs; and WHEREAS, the City Council desires to encourage transient, recreational use of Union Wharf and City Dock, Pope Marine Building and Chetzemoka Park Facility to ensure equal opportunity for use by all members of the public; and WHEREAS, the City Council desires to amend Chapter 5.46.210, City Dock and Union Wharf Outboard side of Union Wharf- Permitted Activities of the PTMC to reflect more accurately the actual costs of the services; and WHEREAS, the City Council desires to amend Chapter 3.38.020, Chetzemoka Park Facility Use, Fees - Permit - Insurance, to reflect more accurately the actual costs of the services; and WHEREAS, the City Council desires to amend Chapter 3.37.020, Pope Marine Building Use, Regulations and Charges, to reflect more accurately the actual costs of the services; and NOW, THEREFORE, the City Council of the City of Port Townsend ordains as follows: SECTION 1. Chapter 3.37, Pope Marine Building Use, Regulations and Charges Section 3.37.020, "Fees" of the Port Townsend Municipal Code is hereby amended to read as follows: Category I - city supported activity Category 2 - non-profit/community functions Day Uss (8am - 6pm) - First Hour - Additional Hours Evening Use (6:30 - midnight weekdays) Weekend Use (Friday, Saturday or Sunday) - First Hour - Additional Hours - Flat rate per day Category 3 - profit-making ent., private parties Day Use (Sam - 6pm) - First Hour - Additional Hours Evening Use (6:30 - midnight weekdays) Weekend Use (Friday, Saturday or Sunday) - First Hour - Additional Hours - Flat rate per day Deposits and refunds no fee e~n$15 $$ $10 $20 ~n$15 ~nn $150 $25 $30 ~$15 $35 $!5 $20 eonn $250 - Cancellation refund fee (90 days) $ ! 5 $20 - Deposit for 19 or less people, no food or alcoholS50 $75 - Deposit of 20 or more people, or with food or alcohol $!59 $200 SECTION 1. Chapter 3.38, Chetzemoka Park Facility Use Section 3.38.020, "Fees - Permits - Insurance" of the Port Townsend Municipal Code is hereby amended to read as follows: Category 1 - Category 2 and 3 - More than - reservations 30 days in advance - ½ fee deposit within 2 weeks - cancellation refund fee (30 days before) $! 5 $20 - Damage Deposit rv~ 11 - 25 people 26 - 75 people 76 - 125 people 126 or more people 10 g-5 people - no fee -2-6 10 people No-f $50 $100 $150 e~n $200 2 SECTION 1. Chapter 5.46, City Dock and Union Wharf Use, Regulations and Charges Section 5.46.210, "Outboard Side of Union Wharf Permitted Activities" of the Port Townsend Municipal Code is hereby amended to read as follows: Non Profit- Commercial Vessels 50 - 175 feet (or larger as approved) Less than 50 feet Vessels any size - Recreational Vessels 50 - 175 feet (or larger as approved) Less than 50 feet No fee eonn $250 moorage fee ?.7~ $200 moorage fee $60 load/unload fee $100 $125 moorage fee $7~ $100 moorage fee SECTION 2. Severability. If any clause, sentence, paragraph, section or part of this Ordinance or its application to any person or circumstance is held to be invalid or unconstitutional by a court of competent jurisdiction, such order or judgment shall not affect the validity or constitutionality of the remainder of any part of this Ordinance. To this end, the provisions of each clause, sentence, paragraph, section or part of this law are declared severable. This ordinance shall take effect December 31, 1999_. Read for the first, second, and third times and passed by the City Council of the City of Port Townsend, Washington, at a regular meeting thereof, held this twentieth day of December, 1999.
