HomeMy WebLinkAbout2731 Amending Various Fee SchedulesOrdinance No. 2731 AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING SECTION 3.36.020, PUBLIC WORKS AND UTILITY BILLING SERVICE FEE SCHEDULE, PERMIT, APPLICATION AND APPEAL FEES, WAIVER AND VARIANCE REQUEST CHARGES, WATER RESERVATIONS, LATECOMER AGREEMENT ADMINISTRATION FEES, LIMITED HYDRANT USAGE CHARGES, WATER TURN-ON/SHUT-OFF CHARGES, REMOVAL AND REINSTALLATION OF WATER METER, SIDE SEWER TAP (REPEALED), SEPTAGE COLLECTION CHARGE, DOCUMENT REPRODUCTION COSTS AND DEPARTMENT OF HEALTH AND TRANSPORTATION CHARGES OF THE PORT TOWNSEND MUNICIPAL CODE. WHEREAS, on January 4, 1999, the City Council adopted Ordinance 2678 at a regularly scheduled Council meeting, whereby Chapter 3.36, Permit, Application and Appeal Fees were modified to reflect a higher percentage of actual costs; and WHEREAS, when Ordinance 2678 waS adopted, amending Ordinance 2619, the City estimated an increase in the cost to certain charges in Port Townsend Municipal Code, Section 1, Chapter 3.36. The City now has updated information and experience upon which to base charges for these services; and WHEREAS, the City Council desires the technical conference credit of $70.00, for project frontage on existing water, sewer and streets(and requiring four hours or less of review time), be removed to reflect the actual cost of providing development review for public utility service; and WHEREAS, the City Council has received requests from utility permit applicants to include a one year extension fee for Public Works Technical Conferences; and WHEREAS, the City Council desires to amend utility permit variances and waiver requests fees to reflect more accurately the actual costs of the services; and WHEREAS, the City Council desires to have water reservation fees in Jefferson County be the same as City water reservation fees to reflect more accurately the actual costs of the services; and WHEREAS, the City Council desires to amend the Latecomer Agreement fees for a single agreement to include more than one utility in the same area to reflect more accurately the actual costs of the services; and WHEREAS, the City Council desires to include in Chapter 13.13 PTMC a separate fee for contractors in Jefferson County for limited hydrant use and language to protect the City in the event there is failure by the contractor to return the meter or damage the meter to reflect more accurately-the actual costs of the services; and WHEREAS, the City Council desires to repeal the side sewer tap for both residential and non-residential use as this is no longer applicable since the elimination of the $70.00 technical conference credit for frontage on existing sewer lines; and WHEREAS,. the City Council desires to amend language for first time water turn-on charges that are incorporated in the meter installation charge, and the ability of utility customers to mm-on/turn-off their water on their own with no charge from the City, as well as any damages, to reflect more accurately the actual costs of the services; and WHEREAS, the City Council desireS to revise document reproduction charges to include copies generated from a computer and the charges for any report plans to be the actual cost of reproduCtion to reflect more accurately the actual costs of the services; and WHEREAS, the City Council desires to revise septage collection charges set forth in Chapter 3.36 PTMC to reflect changes in actual costs of administrative, handling and collection services; and WHEREAS, the City Council desires to amend language for project review charges from the state departments of health and transportation, to reflect actual costs that are passed onto the city, NOW, THEREFORE, the City Council of the City of Port Townsend ordains as follows: SECTION 1. Chapter 3.36, PERMIT, APPLICATION AND APPEAL FEES Section 3.36.020, "Public works and utility billing service fee schedule," subsections 1, 2, 5, 6, 9, 10, 13, 18, 19, 23, 26, 28, and 29 of the Port Townsend Municipal Code is hereby amended to read as follows: Table 3.36.020 Description Charges 1. However, in the event it is not possible to forward more than one application, the applicant will be required to pay this amount in its entirety prior to the city processing any such applications. 29. SECTION 2. Severability. If any clause, sentence, paragraph, section or part of this Ordinance or its application to any person or circumstance is held to be invalid or unconstitutional by a court of competent jurisdiction, such order or .judgment shall not affect the validity or constitutionality of the remainder of any part of this Ordinance. To this end, the provisions of each clause, sentence, paragraph, section or part of this law are declared severable.
