A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
TOWNSEND, AUTHORIZING MAYOR TO COMPLETE AN AGREEMENT
WHEREAS, Sensible Sewage Solutions has filed a lawsuit against the
City of Port Townsend challenging the City's zoning and SEPA
determinations for the City's proposed wastewater treatment plant
improvements, and
WHEREAS, Sensible Sewage Solutions has filed an appeal to the
Shorelines Permit for the proposed wastewater treatment plant
improvements, and
WHEREAS, the State Department of Ecology has directed the City to
construct wastewater treatment plant improvements in a timely
basis, and
WHEREAS, the City of Port Townsend and Sensible Sewage Solutions
have reached substantial agreement on the differences between them,
NOW THEREFORE, be it resolved by the City Council of the City of
Port Townsend that the Mayor be authorized to complete a settlement
agreement in essentially the same form as is show~ on the attached
draft.
Adopted by the City Council of the City of Port Townsend and signed
