AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PORT
TOWNSEND, WASHINGTON, REPEALING AND AMENDING CERTAIN
SECTIONS OF TITLE 2, ADMINISTRATION AND PERSONNEL, OF THE
PORT TOWNSEND MUNICIPAL CODE, ELIMINATING CHAPTERS:
2.28 - PARK AND RECREATION COMMISSION); 2.30 - LIBRARY BOARD;
2.70 - NONMOTORIZED TRANSPORTATION ADVISORY COMMITTEE; AND
AMENDING CHAPTER 2.72 - HISTORIC PRESERVATION COMMITTEE AND
CHAPTER 2.74 - LODGING TAX ADVISORY COMMITTEE; ALSO
REPEALING CERTAIN SECTION OF TITLE 20, ADMINISTRATION OF
LAND DEVELOPMENT REGULATIONS, SECTION 20.06 - BOARD OF
APPEALS
WHEREAS, the City Council determines that it is appropriate to remove from
the Port Townsend Municipal Code all references to the various advisory city committees
(except for certain committees established pursuant to state law, interlocal agreement, or
otherwise, for example, Lodging Tax Advisory Committee, HistOric Preservation
Committee, Planning Commission) in order to provide more flexibility in assigning tasks
and providing direction to committees formed by the City Council.
WHEREAS, the City Council intends to form citizen advisory boards and
committees by resolution to allow for more flexibility and specific tasking of projects;
and
WHEREAS, the City Council desires to generalize provisions applicable to all
committees by separate resolution,
NOW, THEREFORE, the City Council of the City of Port Townsend does
ordain as follows:
SECTION 1. Chapter 2.28, Park and Recreation Commission, of the Port
Townsend Municipal Code, is hereby repealed in its entirety.

4. Prep~e ~d propose revisions to design review gUidelines for evalUating development
proposals. Such proposed revisions shall be fo~arded to BCD for review ~d
recommendation to the plying commission ~d the city co~cil. Design guidelines and
~y revisions foxing the bases of HPC review ~d recommendations must be focally
adopted by the city co~cil.
B. Functions. In addition to the authority prescribed above, the HPC may to the extent
possible ~d at its discretion perfo~ the following ~nctions:
1. Provide information to the public on incentives for prese~ation of historic resources;
2. Within the historic district, ~eview and cogent upon the conduct ~d regulation of
land use, development and m~icipal improvements 'MtNn t~e Nstefic district;
3. Make recommendations to the mayor ~d city council upon request on matters of city
histou ~d historic prese~ation;
4. Provide design guidelines ~d recommend reso~ces upon request of ~ owner of
prope~ within the historic district; ~d provide review ~d advice, upon the request of
the director of BCD (or designee), of applications for pe~its, variances, enviromental

assessments or impact statements, and other similar approvals pertaining to identified
historic resources or adjacent properties;
5. Participate in, promote and conduct public information, educational and interpretive
programs pertaining to historic resources;
6. Provide information to the public on methods of maintaining and rehabilitating historic
properties. This may take the form of pamphlets, newsletters, workshops or similar
activities;
7. Establish liaison support, communication and cooperation with federal, state and other
local government entities which will further historic preservation objectives, including
public education, within the city area;
8. As they relate to historic resources within the historic district, l~_eview and comment to
the planning commission and city council on land use, housing, redevelopment,
municipal improvement and other types of planning and programs undertaken by any
agency of the city, other neighboring communities, the county, the state or federal

9. Officially recognize excellence in the rehabilitation of historic buildings, structures,
sites and districts, and new construction in historic areas; and encourage appropriate
measures for such recognition;
10. Such other functions as directed by the mayor or city council. (Ord. 2522 § 1, 1996;

2.72.070 Eligible property for special tax valuation.
For the purposes of historic property tax valuation authorized as a duty of the committee
under PTMC 2.72.060(A), the class of eligible property is:
A. Property within the city's C-III zoning district; and
B. Property within that area nominated to the National Register of Historic Places and
defined therein as pivotal, primary, secondary, altered historic, or recent compatible.

2.74.060 Authodty ~d ~ctio~s.
A. Lodging Tax Proposal Review. Not less th~ 45 days before t~ing final action on any
lodging tax proposals enmerated in this subsection, the Po~ Tomsend city co~cil shall
submit to the lodging tax adviso~ co~iRee, for its review ~d cogent, proposals
reg~ding the following:
1. The imposition ofa t~ under Ch. 67.28 RCW SSB 5867;
2. Any change in the rate of such tax;
3. Repeals or exemptions from such a tax; or
4. A ch~ge in the use of the revenue received from such a tax.
B. Repo~ from the lodging t~ adviso~ committee. Upon receiving a proposal ~om the
Po~ Tomsend city co~cil, the lodging tax adviso~ commi~ee shall ~alyze the extent
to which the proposal ~11 accommodate activities for to~ists, or increase tourism, ~d
the extent to which the proposal will affect the long-r~ge stability of the city f~d
created for the lodging tax revenues. The commi~ee shall submit a ~itten
reco~endation to the Po~ To--send city council within ~ 42 days of receiving the
proposal ~om the city co~cil. The repo~ shall be adviso~ to the Po~ To--send city
co~cil, ~d shall not be binding upon the council. Failure of the commi~ee to submit its
repo~ to the city co~cil in a timely fashion prior to passage of the proposal shall not
prevent the city co~cil from acting on the proposal.
C. To,ism Plying. The lodging t~ adviso~ co~i~ee shall be authorized to engage
in to,ism plying ~d promotion activities as outlined in the To',~sm Development,

adopted or hereafter mended.
D. Tourism promotion ~d to,ism-related hcility prQect applications. The lodging tax
advisou committee is authorized to perfo~ initial review of applications for lodging tax
funding ~d to m~e recommendations to the Po~ Tomsend city council regarding
which projects the city should ~nd. However, this grant of authority shall not be
construed to require the city co~cil to submit such proposals to the co~ittee for initial
review in addition to the review process set forth in subsection A of this section. If any
expenditures will constitute an mendment to the city's ~ual budget, the request shall
be submitted to the lodging tax advisou co~iRee prior to final approval by the city
council.
E. A~inistration of the "Comm~ity Request F~d" Progrm. The city of Po~
Tomsend administers a "Co--unity Request Fund" (C~) to provide f~ds for
adve~ising, publicizing, ~d othe~ise distributing info~ation for the p~ose of
attracting visitors ~d enco~aging to~ist exp~sion within Po~ To,send. The C~ is
generated from lodging tax revenues. The lodging tax advisory co~i~ee is authorized
to review requests for hnds from the C~ ~d to make reco~endations to the city
co~cil's tin,ce commi~ee to authorize such expenditures, Mthom f~her confi~ation
by the city co~cil, not to exceed the ~ually budgeted mo~t, with hnding for each
request in a m~imum mo~t of $1,000.

F. Report to Washington State Depm~mevX '-*'v. o~v..~..~....;;,,,, Office of Trade and Economic
Development (DCTED OTED). The lodging tax advisory committee shall assist the city
in compiling the report to DCTED, as required in SSB 5867, Section 6. (Ord. 2607 § 1,
1997).
SECTION 6. Chapter 20.06, Board of Appeals, of the Port Townsend Municipal
Code, is hereby repealed in its entirety.

SECTION 7. Severability. If any provision of this ordinance or its application
to any person or circumstance is held invalid, the remainder of the ordinance, or the
application of the provision to other persons or circumstances is not affected.
SECTION 8. Effective Date. This ordinance shall take effect and be in force
five days after the date of its publication in the manner provided by law.
Adopted by the City council of the City of Port Townsend, Washington, at a
regular meeting thereof, held this 19th day of March, 2001.
