A RESOLUTION AUTHORIZING AN INDEMNIFICATION AGREEMENT
WITH IMCO GENERAL CONSTRUCTION REGARDING DAMAGES WHICH
MIGHT OCCUR TO PARTICIPANTS IN RAFT RACES WHICH ARE TO BE
HELD AT A CELEBRATION OF THE COMPLETION OF THE CITY'S
SECONDARY WASTEWATER TREATMENT PLANT
WHEREAS, the City of Port Townsend is nearing completion of the secondary
wastewater treatment plant being constructed by Imco General Construction; and
WHEREAS, Imco, under its construction contract with the City, is required to
indemnify and hold the City harmless from all suits and liability arising from construction of the
treatment plant; and
WHEREAS, Imco does not wish to be exposed to potential liability from participants
in a raft race to be conducted on site as part of the celebration; Now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF PORT TOWNSEND
THAT:
The Mayor is hereby authorized to execute an Indemnity Agreement with Imco General
Construction Company in substantially the same form as attached hereto indemnifying against
suits, liability or damage from the participants in a raft race to be conducted at the site of the
secondary wastewater treatment plant.
