A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
TOWNSEND AUTHORIZING THE CLERK/TREASURER TO SEGREGATE
AN ASSESSMENT FOR LOCAL IMPROVEMENT DISTRICT NO. 1.
WHEREAS, upon the formation of LID Number 1 the local title insurance companies were
informed of the assessment roll for the District; and
WHEREAS, despite that notification one of the title companies failed to inform prospective
purchasers of the formation of the LID; and
WHEREAS, purchasers of several lots which had been subdivided from larger ownerships were
not made aware of the assessments by the title company and payments were not made of
the assessments at closing; and
WHEREAS, the prior owners of the properties have requested a segregation of the subdivided
lots to allow a payout of the assessments for the subdivided parcels; and
WHEREAS, the City Attorney has advised that RCW 35.44.410 allows such segregations of
the assessments to accommodate subdivision of properties; Now, Therefore:
BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF PORT
TOWNSEND:
The City Clerk/Treasurer is hereby authorized and directed to segregate the assessment
for parcel 1-4127-6 in Local Improvement District No. 1 to accommodate subdivision of the
parcel.
