A RESOLUTION AUTHORIZING THE MAYOR TO RESCIND A
RESTRICTIVE COVENANT PLACED ON LOTS 5 AND 6 OF BLOCK 10,
HILLS ADDITION TO THE CITY OF PORT TOWNSEND.
WHEREAS,
a previous property owner, at the request of the City of
Port Townsend, executed a restrictive covenant dated July
13, 1988, and recorded the covenant with the Jefferson
County Auditor under Auditor's File No. 315815; and
WHEREAS,
the covenant recorded was intended to bind Lots 5, 6, 7
and 8 together as one building site for purposes of
complying with building zoning and utility codes; but
which covenant in error encumbered only Lots 5 and 6; and
WHEREAS,
thecurrent owner has provided a seperate sanitary sewage
system and water supply for the residence on Lots 5 and
6; and
WHEREAS,
due to the installation of seperate utility services on
Lots 5 and 6, the intended purposes for which the
covenants were executed and placed upon the property no
longer exist; the covenants can be revoked and compliance
with applicable codes and ordinances maintained; and the
City of Port Townsend consents to revocation of the
covenants; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City
of Port Townsend authorizes the Mayor to rescind the
covenants recorded under auditor's file 315815.
BE IT FURTHER RESOLVED, that this resolution shall be recorded with
the Jefferson County Auditors office.
Adopted by the city Council in regular session assembled this 6th
Day of Dec,ember, 1993.
