A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN AGREEMENT
WITH CITIFOR; INC. REGARDING THE PURCHASE OF TIMBER AND
AN AGREEMENT MEMORIALIZING THE UNDERSTANDINGS WHICH
UNDERLIE BOTH THE TIMBER PURCHASE AND THE NEGOTIATIONS
REGARDING THE ACQUISITION OF LAND WITHIN THE CITY LAKE
WATERSHED ~ AUTHORIZING THE CLERK/TREASURER TO ISSUE
WARRANTS FOR THE PURCHASE OF TIMBER FROM CITIFOR; INC.

The City of Port Townsend has been ordered by the state
Department of Health to control activities which could
adversely affect water quality within the watersheds from
which surface water is drawn for the City's water system
if the City is to avoid the construction of costly water
filtration facilities which would otherwise be required
by the surface water treatment rule; and
The City Lake watershed is within the scope of said
order, as clarified by a letter from the Department of
Health dated June 18, 1993; and
Citifor, Inc., is the owner of a right to harvest timber
within the City Lake watershed on 14 acres of sloping
land adjacent to City Lake recently acquired by Pope
Resources from Citifor, Inc.; and
The City, in the interest of maintaining a vegetated
buffer for slope stabilization and erosion control to
better protect the quality of water draining into City
Lake, has negotiated the terms of an agreement with
Citifor, Inc., for the purchase of timber which otherwise
would have been harvested as part of a major logging
operation within the Pope Resources property, pursuant to
the timber right owned by Citifor, Inc.; and
The purchase price of $102,000 for the timber is based on
an appraisal performed by Jackson & Prochnau,
Incorporated, consulting forest engineers,under contract
with the City and does not exceed the market value of the
timber as determined bysuch appraisal, which utilized an
income approach to value; and
The funds for said purchase have been budgeted for 1993;
and
Pope Resources has agreed to negotiate with the City
regarding the acquisition bythe City of the remaining 40
acres within the City Lake watershed not previously
purchased by the City, including the 14 acres which is
subject to the timber right owned by Citifor, Inc.; and
It is the sense of the City Council that it is desirable
for the City to enter into a written agreement which
would memorialize the understandings which underlie both
the purchase of the timber from Citifor, Inc., and the
negotiations regarding the acquisition of the land the
City will be acquiring from Pope Resources,
N O W T H E R E F O R E
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND
that it authorizes the Mayor to sign an agreement regarding the
purchase from Citifor, Inc., of timber adjacent to City Lake for
$102,000, and an agreement memorializing the understandings which
underlie both the timber purchase and the negotiations for the
acquisition by the City of 40 acres owned by Pope Resources within
the City Lake watershed; and
BE IT FURTHER RESOLVED that the Clerk/Treasurer is authorized to
issue the warrants necessary to complete' the purchase of timber
from Citifor, Inc., pursuant to said agreement.
Adopted by the City Council of the City of Port Townsend and signed
