A RESOLUTION AUTHORIZING THE PUBLIC WORKS DEPAR1)mENT TO BUY BACK
RESERVATION RIGHTS REGARDING UNUSED WATER TAPS RESERVED BY TRICO
LAND CONPANY FOR A PORTION OF DISCOVERY BAY HEIGHTS WHICH WILL NOT
BE DEVELOPED AND AUTHORIZING THE CLERK/TREASURER TO ISSUE THE
WARRANTS WHICH MAY BE NECESSARY TO CONPLETE THE TRANSACTION.
WHEREAS,
Trico Land Company in 1979 reserved and paid a deposit for 107 water
taps at the rate of $100 per tap for a phased development known as
Discovery Bay Heights and the City stipulated that it would buy back
any taps not used for the development within 10 years; and
WHEREAS,
Phase ] of said developmeflt was completed in lg81 and water taps
were installed for 33 lots; and
WHEREAS,
By letter dated December 2g, 1981, Trico Land Company informed the
City that water taps for no more than 36 additional lots would be
required and a refund of $3,800 was made to Trico Land Company for
the release of its reservation with respect to 38 water taps; and
WHEREAS,
Of the remaining 36 reserved taps, only one has been used to provide
water to a common area within the development; and
WHEREAS,
It has been recommended by the Public Works Department that the City
now buy back the reservation rights with respect to the 35 unused
taps at the rate of $100 per tap; and
WHEREAS,
It is the finding of the City Council that it would be in the best
interest of the City to'follow said recommendation,
N 0 W T H E R E F 0 R E
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND that it hereby
authorizes the Public Works Department to buy from Trico Land Company its
reservation rights with respect to 35 reserved but unused water taps at the rate
of $100 per tap, and
BE iT FURTHER RESOLVED that the Clerk/TrE
warrants necessary to complete such~
