HomeMy WebLinkAbout2790 Records Management and Records Retention FeesOrdinance No. 2790 AN ORDINANCE OF THE CITY OF PORT TOWNSEND ADDING SECTION 2.76.031 TO THE PORT TOWNSEND MUNICIPAL CODE - FEES ADDED FOR RECORDS RETENTION - ADDING A FEE TO CERTAIN PERMIT AND LICENSE FEES FOR THE PURPOSE OF FUNDING RECORDS RETENTION AND RECORDS MANAGEMENT (INCLUDING ELECTRONIC STORAGE), AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City faces increasing costs in connection with meeting state records retention requirements; WHEREAS, the City Council of the City of Port Townsend, based on recommendation of the City Clerk, determines that electronic storage of records and retrieval will serve the public by making records more readily available, and help meet state records retention requirements, and thata records fee should be placed on applications to the City that result in certain permanent and long-retention records, which fee would support the electronic storage and retrieval of those records. NOW, THEREFORE, the City Council of the City of Port Townsend does ordain as follows: SECTION 1. New Section. There is hereby enacted and added to the Port Townsend Municipal Code a new section, "Fees Added for Records Retention," to read as follows: 2.76.031 Fees Added for Records Retention. There shall be added to each of the following fees, licenses, and applications, a fee of five (5) % of the fee established by the Port Townsend Municipal Code (rounded to the nearest quarter of a dollar), however, in no event shall the fee be less than less than $3.00 or greater than $10.00, to be earmarked for administrative functions related to records retention and management. 1. All fees for applications set forth in PTMC 20.01.100; 2. All business license fees (one time only on initial application or first renewal after the initiation of the fee); 3. All fees for special event permits SECTION 2. Severability. If any provision of this ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance, or the application of the provision to other persons or circumstances is not affected. 1 Ordinance 2 790 SECTION 3. Effective Date. This ordinance shall take effect and be in force on January 1, 2002, which is more than five days after the date of its publication (or a publication of a summary) in the manner provided by law. Adopted by the City Council of the City of Port Townsend, Washington, at a regular meeting thereof, held this 17th day of December, 2001.
