RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND
AUTHORIZING THE MAYOR TO SIGN A LICENSE AGREEMENT WITH NEW
DAY FISHERIES FOR USE OF A PUBLIC RIGHT-OF-WAY
The City Council of the City of Port Townsend, Washington, does resolve as follows:
WHEREAS, the City has agreed to enter into this License Agreement because the
portion of the right-of-way at issue is unopened, is not currently used by the public for access
or travel, and is not anticipated to be used during the term of this License Agreement; and
WHEREAS, this License Agreement is revocable at will by the City; and
WHEREAS, the Building and Community Development Department has discussed the
proposed use of the right-of-way with all adjoining landowners, who have indicated and agreed
that they do not object to the proposed use of the public right-of-way" and do not need it for
access to their properties; and

~WHEREAS, the proposed use will not obstruct pedestrian or vehicle access on the right-
of-$ay,Pí will not materially interfere with the normal public use of the water or shorelines of
the state; and
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Port
Townsend that the Mayor is authorized to sign a License Agreement with New Day Fisheries
for use of the Thayer Street public right-of-way in substantially the same form as attached.
