RESOLUTION NO. 95-W
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
TOWNSEND AUTHORIZING THE MAYOR TO SIGN CHANGE ORDER
ONE FOR A CREDIT OF $8,400.00 FOR MODIFICATIONS TO THE
LORD'S LAKE PIPELINE EXTENSION MADE BY PRIMO
CONSTRUCTION, INC.
WHEREAS, The City has engaged the services of Primo Construction, Inc. as the
Contractor to perform the construction of the Lord's Lake Pipeline
Extension project; and
WHEREAS, In the course of performing the work and with the intent of preventing
a substantial delay in the work, the Contractor substituted pipe
coupling materials without Change Order approval; and
WHEREAS, Change Orders are actual changes to the original contract, requiring
prompt, fair negotiation and signatures by the City and the Contractor;
and
WHEREAS, The City wishes to reserve acceptance until a final inspection can be
conducted to verify pipeline performance; and
WHEREAS, The Contractor continues to demonstrate commitment to completing the
project and has tentatively agreed to conditions of the proposed Change
Order No.1, .

Be it resolved that the City Council of the City of Port Townsend does hereby
authorize the Mayor to:
A. Sign Change Order No.1 for a credit amount of $8,400.00; and

B. Approve Pay Request No.1 including a payment of interest based on a rate of
current savings interest available to the City.
