RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
TOWNSEND APPROVING WAIVER OF PERMIT AND APPLICATION
FEES FOR "FAMILY AND FRIENDS" PROJECT
The City Council of the City of Port Townsend, Washington, does resolve as follow:
WHEREAS, Family and Friends, a non-profit corporation, 908 Oak Street, Port
Townsend, Washington, has acquired a residence located at 935 Hendricks Street, Port
Townsend, which will be renovated for the purpose of housing loW-income, developmentally
disabled adults; and
WHEREAS,' Family and Friends has IRS 501(c)(3) status; and
WHEREAS, Family and Friends has been awarded a special mortgage from the
Washington State Housing Trust Fund, for the purpose of acquiring and renovating the home;
and
WHEREAS, funds received by Family and Friends are inadequate to accomplish all
property acquisition and renovation work; and
WHEREAS, the City of Port Townsend is prohibited by the Washington State
Constitution, Article 8, Section 7, from lending credit and from granting gifts of public funds
to private parties, with the exception of funds necessary for the support of the "poor and
infirm"; and
WHEREAS, the Port Townsend City Council deems it necessary and appropriate to
waive permit and application fees payable under Chapter 3.36 PTMC for Family and Friends,
to facilitate renovation of the Port Townsend residence, which will house persons fitting within
the definition of "poor and infirm" contained within the Washington State Constitution,
NOW, THEREFOR, BE IT RESOLVED, by the City Council for the City of Port
Townsend as follows:
The City of Port Townsend, and the Port Townsend Building and Community
Development Department, shall waive all permit and application fees payable under Chapter 3.36
PTMC, to a maximum of $1,000.00, for the renovation work at the residence located at
935 Hendricks Street, Port Townsend, Washington.
This Resolution shall not be construed as waiving any other fees, charges, utility rates,
or any other amounts payable to the City of Port Townsend, other than those payable under
Chapter 3.36 PTMC for building permits and applications fees.
ADOPTED by the City Council of the City of Port Townsend and signed by the Mayor
on this $ ~ day of March, 1995.
