RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
TOWNSEND DECLARING AN EMERGENCY AND AUTHORIZING
THE MAYOR TO PROCEED WITH BIDDING FOR THE CT
COMPLIANCE PROJECT.
The City Council of the City of Port Townsend, Washington, does resolve as follows:
WHEREAS, the City is under an Agreed Order with the Washington State Department
of Health (DOH) to comply with the Surface Water Treatment Rule and meet CT
requirements for the Tri-Area. This Order is currently being revised by DOH and will
require the City to meet CT in the Tri-Area by June 1, 1995. To meet this requirement,
the Sparling and Kivley wells and treatment system must be operated on a full-time basis
and a tie-in to the Olympic Gravity Water System (OGWS) must be made; and
WHEREAS, some customers in the Tri-Area receive water that does not meet CT and
this continues to present a potential health risk to these customers; and
WHEREAS, over the last several years the Tri-Area wells have been used only on a
part-time basis to meet peak water demand requirements. In order to be operated
reliably on a full-time basis the well and treatment system are in need of upgrade; and
WHEREAS, in past years use of the Tri-Area wells have been needed in early June to
meet peak water demands; and
WHEREAS, the City has begun evaluation of the existing Sparling well and, as a result
of investigations since March 13, 1995, has found significant problems with the well
including sedimentation and corrosion. To improve the reliability of the system requires
that the City repair and potentially rescreen the well or install a new well. In order to
evaluate the reliability of the well and/or site a new well, it will be necessary to install
monitoring wells and perform aquifer testing using the Sparling well. Because of the
critical water supply function that this well serves for the Tri-Area, the City must
contract immediately for repairs or upgrades that may be necessary and perform the
required aquifer testing. These problems with the Sparling well were previously
unknown and need to be addressed immediately; and
WHEREAS, the tie-in to the OGWS is required as part of the City CT pipeline project
and can be done only during a shutdown at the Port Townsend Paper Mill. This occurs
only once per year for a short period. A three day mill shutdown is scheduled for May 8
and the tie-in to the pipeline must be made at this time. The time remaining to complete
this work does not allow the City to utilize conventional municipal public bidding
procedures.

NOW THEREFORE, BE IT RESOLVED, by the City Council for the City of Port
Townsend as follows:
An emergency exists with regard to the critical need for a reliable well supply, the
need to operate the wells 'on a full-time basis and the need for a tie-in to the
OGWS, all within the time constraints imposed by the mill shutdown and the
DOH order.
An emergency exists in meeting the requirements of the DOH order in a timely
fashion, prohibiting utilizing conventional public bidding procedures for all
components of the project.
Public bidding requirements are waived with respect to the following specific
components of the project. The Mayor is authorized to purchase the following
equipment and to direct City work crews to undertake the following work in order
to assure that a reliable supply of water is provided to City water customers:
Valves, piping and other equipment for the OGWS tie-in during the mill
shutdown;
Use City work crews to assist the mill crews to perform the work on the OGWS
tie-in.
The City Council waives public bidding requirements and authorizes the Mayor to
hire a contractor to perform the following work:
Sparling well repairs and upgrades, as well as installation of monitoring wells.

All other work required to comply with the DOH Order and to upgrade the wells
shall be subject to public bidding procedures pursuant to RCW 35.23.352.
The Mayor is authorized to advertise for bids for all other construction and
equipment items related to the well treatment system upgrade and CT compliance
project in the Tri-Area, specifically the tie-in to the PUD 12" water line.
Adopted by the City Council of the City of Port Townsend and signed by the Mayor this
