EASEMENT REGARDING LAND IN THE CITY OWNED BY JEFFERSON
LAND TRUST
Whereas,
Jefferson Land Trust, a Washington nonprofit corporation,
is 5he owner of Block 10 of Baker's Addition to the City
of Port Townsend; and
Whereas,
Jefferson Land Trust wishes to permanently restrict land
uses within the above-described property in order to
preserve a natural, wooded, open space area in a portion
of the City which is experiencing increasing residential
development; and
Whereas,
Jefferson Land Trust has requested that the City accept
the donation and conveyance of a conservation easement,
pursuan5 to the authority granted the City by RCW
64.04.130; and
Whereas,
The conservation easement will convey to the City all of
the rights which Jefferson Land Trust now holds as the
owner of the property regarding residential, commercial
or industrial development of the property, as well as the
rights of the land trust to harvest timber resources and
to disturb native vegetation within the property; and
Whereas,
Following the conveyance, Jefferson Land Trust will
continue to own the property subject to the restrictions
created by the conservation easement, which will preclude
the future development of the property and preserve it
as a natural area; and
Whereas,
It is expressly provided in the conservation easement
that Jefferson Land Trust will continue to bear all
respcnsibilities and liabilities attendant to the
ownership of the property and that the City will be held
harmless from all liability and costs which might arise
from the acceptance of the conservation easement,
N O W T H E R E F O R E
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND
that it authorizes the Mayor to sign a conservation easement to be
conveyed to the City by Jefferson Land Trust affecting Block 10 of
Baker's Addition to the City of Port Townsend, as per plat recorded
in Volume 1 of Plats, page 75, records of Jefferson County,
Washington.
