HomeMy WebLinkAbout2805 Utility Latecomer Agreements - To Correct an Incomplete SentenceOrdinance No. 2805 AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING PORT TOWNSEND MUNICIPAL CODE, SECTION 13.04.050 PUBLIC WORKS DIRECTOR'S DETERMINATION APPEAL, CHAPTER 13.04, UTILI~ LATECOMER AGREEMENTS, TO CORRECT AN INCOMPLETE SENTENCE WHEREAS, by Ordinance 2515 dated March 18, 1996, the Utility Latecomer Agreements procedures were adopted under Chapter 13.28; and WHEREAS, by Ordinance 2579 dated April 21, 1997, the Utility Latecomer Agreements procedures were reorganized and amended into Title 13; and WHEREAS, it was recently noticed that Section 13.04.050(A)(5) is incomplete; NOW, THEREFORE, the City Council of the City of Port Townsend ordains as follows: SECTION 1. Chapter 13.04, Utility Latecomer Agreements, Section 13.04.050, Public Works Director's Determination - Appeal, of the Port Townsend Municipal Code is hereby amended to read as follows: 13.04.050 Public works director's determination - Appeal. A. Approval of Application. The public works director shall review all applications and shall approve the application only if the following requirements are met: 1. The project satisfies the minimum cost requirement and complies with city design and construction standards and all applicable federal, state, and local laws, rules and regulations, including but not limited to the city of Port Townsend Municipal Code for water, sewer and stormwater and environmental laws; 2. The proposed improvements fall within the definition of water, sewer, and/or storm drainage improvements; 3. The proposed improvements are not constructed or currently under construction; 4. The proposed improvements are consistent with the city's comprehensive plan, utility plan, and/or transportation plan; and 5. The city has the capability and the capacity to service the water, sewer, and/or storm drainage improvement. Page 1 Ordinance 2805 SECTION 2. Severability. If any provision of this ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance, or the application of the provision to other persons or circumstances is not affected. This ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law. Adopted by the City Council of the City of Port Townsend, Washington, at a regular meeting thereof, held this 6th day of May, 2002.
