RESOLUTION NO. 95- ~
A RESOLUTION APPROVING THE RIGHT OF WAY PLAN FOR THE SAN
JUAN AVENUE IMPROVEMENT PROJECT AND AUTHORIZING THE
EXPENDITURE OF FUNDS FOR THE ACQUISITION OF RIGHT OF WAY
The City is undertaking certain improvements to San Juan
Avenue as its contribution to the construction of Blue
Heron Middle School; and
The City's design consultant, Perteet Engineering, Inc.,
has developed a design for the project based on public
input which necessitates the acquisition of additional
right of way to accommodate the design features; and
A Right of Way Plan has been prepared to meet the
requirements of this Federally-funded project; and
A True Cost Estimate has been prepared by Christopher
Eldred, MAI, in accordance with project requirements for
the purpose of estimating the cost of acquiring right of
way within individual parcels of real property; and
Prior to initiating negotiations with property owners
regarding right of way acquisitions, the Right of Way
Plan and True Cost Estimate both must be approved by the
Washington State Department of Transportation; and
In recognition of the objective of completing this
project as soon as possible and in order to expedite the
acquisition of right of way, it is the sense of the City
Council that it is reasonable to authorize the
expenditure of funds for right of way acquisitions based
on the estimated values reflected in the True Cost
Estimate,
N O W T H E R E F O R E
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND
that the Right of Way Plan prepared by Perteet Engineering, Inc.,
and the True Cost Estimate prepared by Christopher Eldred, MAI, for
the San Juan'Avenue improvement project are hereby approved; and
BE IT FURTHER RESOLVED that the expenditure of not more than
$50,000 for the acquisition of right of way is hereby authorized;
and
BE IT FURTHER RESOLVED that the Acting Treasurer is authorized to
issue the warrants necessary to complete the right of way
acquisitions within the limits hereby specified.
Adopted by the City Council of the City of Port Townsend and signed
by the Mayor this. 5th day of ~995.
