A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN AGREEMENT
WITH HENRY KIMBALL AND ELSIE KIMBALL REGARDING THE
PURCHASE OF LAND IN THE CITY AND AUTHORIZING THE ACTING
TREASURER TO ISSUE WARRANTS FORT HE PURCHASE OF THE LAND
IN ACCORDANCE WITH THE AGREEMENT
Whereas,
The City, as a designated Urban Growth Area under the
Growth Management Act, is anticipating the need to
construct an enlarged sanitary sewer trunk line based on
projected population increases; and
Whereas,
It is expected that the routing of the new trunk line
will be parallel to and East of the alignment of an
existing sewer easement running for the most part through
unplatted land; and
Whereas,
Portions of the existing easement run through platted
land, including Lot 8 of Happy Valley PUD adjacent to
Blue Heron Middle School, which will be subject to
increasing development pressure; and
Whereas,
Due to the diagonal alignment of .the easement through
said Lot 8, any residential development would leave no
room for the construction of a new trunk line through
this area, due to the proximity of a wetland to the West
of said Lot 8; and
Whereas,
Henry Kimball and Elsie Kimball, as Trustees of a
revocable family trust which owns the lot, have agreed to
sell Lot 8 of the Happy Valley PUD to the City for
$28,500, which is in the range of value estimated by
Halberg Pacific Appraisal Service; and
Whereas, The funds for this purchase have been budgeted for 1995,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND
that it authorizes the Mayor to sign an agreement with Henry
Kimball and Elsie Kimball, Trustees of the Kimball Family
Revocable Trust, regarding the purchase of Lot 8 of the Happy
Valley PUD; and
BE IT FURTHER RESOLVED that the Acting Treasurer is authorized to
issue the warrants necessary to complete the purchase of the land
in accordance with said agreement.
Adopted by the City Council of the City of Port Townsend and signed
by the Mayor this 20th~1995..
