HomeMy WebLinkAbout95-132Resolution No. 95-/3~- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND APPROVING AND AUTHORIZING THE MAYOR TO SIGN AN INTERLOCAL PROPERTY PURCHASE & MANAGEMENT AGREEMENT WITH THE PORT OF PORT TOWNSEND RE: THOMAS OIL PROPERTY The City Council of the City of Port Townsend, Washington, does resolve as follows: WHEREAS, on May 1, 1995, by Resolution No. 95-52, and after receiving public testimony at an April 17, 1995 City Council meeting, the Port Townsend City Council authorized the Mayor to commence negotiations for purchase of the Thomas Oil Site and to seek out available funding souces; and WHEREAS, public acquisition of the Thomas Oil site was identified as essential to the future character of the Port Townsend Urban Waterfront in the City's 1990 Urban Waterfront Plan; and WHEREAS, the City has been engaging in negotiations with the Port of Port Townsend and the owners of the Thomas Oil property for potential acquisition, which negotiations are continuing; and WHEREAS, it is the policy of the Port Townsend City Council that the City's participation in the acquisition of the Thomas Oil property can proceed only with minimal impacts upon Port Townsend taxpayers; and WHEREAS, Resolution No. 95-52 states that the City would commence negotiation with the Port for an interlocal agreement, "defining the rights and obligations of the City and the Port in the property acquisition as well as long-term property development and management concerns;" and WHEREAS, in order to ensure the best interests of the City and to minimize impacts upon local taxpayers, the Council deems it essential to adopt an interlocal agreement as envisioned in Resolution No. 95-52, prior to any ongoing negotiations with the property owners, and prior to executing a purchase and sale agreement (if any); and WHEREAS, the Council finds that the proposed interlocal agreement fully addresses the Council's current concerns with respect to property acquisition, management and development, and anticipates future revisions to address evolving property management and development concerns, NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Port Townsend that the Council approves the proposed Interlocal Property Purchase & Management Agreement between the Port of Port Townsend and the City of Port Townsend and authorizes the Mayor to sign the interlocal agreement in substantially the same form as attached hereto. on this 18th day of December, 1995.
