HomeMy WebLinkAbout95-133Resolution No. 95-/_~ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND AUTHORIZING WRITE-OFF OF UNCOLLECTIBLE SEWAGE WASTE COLLECTION CHARGES FROM GOODMAN SEPTIC DISPOSAL, INC. The City Council of the City of Port Townsend, Washington, does resolve as follows: WHEREAS, the City of Port Townsend extended Goodman Septic Disposal, Inc. ("Goodman"), credit for sewage waste hauling services, rendered at the City's Biosolids Waste Facility; and WHEREAS, Goodman owes the City $5,724.67 for sewage waste collection and disposal services, plus interest, said amount having been reduced to Judgment on December 15, 1994, Jefferson County Superior Court Cause No. 94-2-00396-7; and WHEREAS, Goodman filed a Petition for Bankruptcy liquidation under Chapter 7 of the United States Bankruptcy Code; and WHEREAS, pursuant to an Order of the Bankruptcy Court dated August 31, 1995, the Bankruptcy Court approved a "Report of No Distribution", finding that the bankruptcy estate had no property available for distribution, over and above that property and value exempted by law; and WHEREAS, the debt owed to the City by Goodman is discharged, with the Bankruptcy Court Order of No Distribution closing the Chapter 7 bankruptcy case, NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Port Townsend that the City Treasurer's Office is hereby authorized and directed to write-off the $5,724.67 from the debtor's account for the City's sewage waste collection services, and from the City's accounts receivable.
