RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
TOWNSEND APPROVING AN AMENDMENT TO THE PINK HOUSE
LEASE AGREEMENT
The City Council of the City of Port Townsend, Washington, does resolve as follows:
WHEREAS, on June 19, 1995, the City Council approved a Lease Agreement and
Renovation Contract for the renovation and long-term lease of the City building known as the "Pink
House" to Little and Little Construction, Inc. ("Little"); and
WHEREAS, Little seeks an amendment to the Lease Agreement to facilitate successful
property use and development; and
WHEREAS, Little has requested that the lease term be expanded from a 20 to a 25 year
period with a 5-year option to renew (rather than a 20-year contract with a 10-year option to renew)
to allow him to capitalize or amortize the renovation improvements over the lease term; and
WHEREAS, Little has requested that the "commencement date" defined in paragraph 3.1
be revised to the date the rezone for the property was approved by the City (December 18, 1995);
and
WHEREAS, the City did not intend to impose a handicap parking requirement on the Tenant
under the Lease Agreement; however, Paragraph 15 could be interpreted to impose such a
requirement and Little has asked the City to modify that paragraph to clarify its intent; and
WHEREAS, in adopting Findings of Fact and Conclusions of the City Council on Little's
application for a conditional use permit, the City added a requirement regarding tenants and/or
clients of the Pink House parking in the library parking lot, which should now be reflected in the
the Lease Agreement;
WHEREAS, the City Council finds these to be minor changes consistent with the intent and
terms of the Lease Agreement,and
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Port
Townsend that the Council agrees to the amendment of the Pink House Lease Agreement, and
authorizes the Mayor to sign the First Amendment to the Lease Agreement in substantially the same
form as attached.
