HomeMy WebLinkAbout96-057A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN AGREEMENT WITH DENNIS SULLIVAN AND MARY SULLIVAN REGARDING THE PURCHASE OF LAND IN THE CITY AND AUTHORIZING THE CITY TREASURER TO ISSUE WARRANTS FOR THE PURCHASE OF THE LAND IN ACCORDANCE WITH THE AGREEMENT Whereas, Whereas, Whereas, Whereas, Whereas, Whereas, The City, as a designated Urban Growth Area under the Growth Management Act (GMA), is anticipating that future development inevitably will increase stormwater runoff within the City's drainage basins identified by the Wetlands and Stormwater Advisory Committee (WETSWAC), comprised of local residents assisted by consultants retained by the City; and Existing natural drainage corridors conveying stormwater have been identified within the City's drainage basins, particularly in less developed areas; and The conservation of natural systems for the conveyance and treatment of stormwater has been demonstrated scientifically to be economically and biologically efficient in comparisons with traditional structural alternatives which entail higher capital investment, as well as higher operation and maintenance expenses; and The City has enhanced the work of WETSWAC by a more detailed hydrology and engineering study of a large drainage basin in the Northwestern portion of the City that currently is relatively undeveloPed, but is platted into hundreds of lots with the potential for intensive development over the 20 year GMA planning period; and A relatively undeveloped natural drainage corridor has been identified and mapped within the Montana Addition and the California Addition plats in the North Beach area that presents a unique opportunity for cost-effective stormwater detention and treatment which would be jeopardized by the extensive residential development allowable under existing zoning ordinances; and Ongoing studies indicate that, under certain possible development scenarios for this drainage basin, portions of this corridor are within a 100-year floodplain and therefore poorly suited for residential uses; and Whereas, Land that may be poorly' suited for development, if conserved in a relatively natural state, can be utilized effectively for stormwater detention and treatment, as well as to provide additional public benefits as open space and wildlife habitat within an urban area in accordance with GMA goals and policies; and Whereas, Block 10 and the East half of Block 9 in Montana Addition has been identified and mapped as being adjacent to and partially within a 100-year floodplain under possible development sCenarios; and whereas, Dennis Sullivan and Mary Sullivan, the owners.of said property, are willing to sell their unimproved land to the City for a price that does not exceed the appraised fair market value determined by an appraisal by Christopher Eldred, MAI, and a review appraisal by Thomas Stowe, MAI, both certified Washington appraisers; and Whereas, Funds have been budgeted for this property purchase in 1996, N O W T H E R E F O R E BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND that it authorizes the Mayor to sign an agreement with Dennis Sullivan and Mary Sullivan regarding the purchase of all of Block 10 and Lots 1 through 4 in Block 9 of the Montana Addition for the price of $40,000; and BE IT FURTHER RESOLVED that the City Treasurer is authorized to issue the warrants necessary to complete the purchase of the land in accordance with said agreement.
