HomeMy WebLinkAbout96-080RESOLUTION NO. 96- ~ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND AUTHORIZING THE MAYOR TO SIGN A REVOCATION OF RESTRICTIVE COVENANT FOR LOTS $, 6, 7 & 8 OF BLOCK $ IN THE WEYMOUTH AND DYER ADDmON TO THE CITY OF PORT TOWNSEND The City Council of the City of Port Townsend, Washington, does resolve as follows: WHEREAS, Lots 5-8 of Block 5 in the Weymouth and. Dyer Addition to the City of Port Townsend is zoned R-l; and Section 17.16.010 of the Port Townsend Municipal Code (PTMC) defines an R-1 zone as primarily a single-family residence district and including the customary accessory secondary uses; and WHEREAS, Chapter 17.08 defines an accessory building as subordinate, the use of which is incidental to the use of the main building on the same lot; and WHEREAS, on September 26, 1994, Robert and Evenell Monica applied for a permit, building permit #9410-01, to construct a boat storage shed; and WHEREAS, a boat storage shed is considered an accessory use in an R-1 zone and therefor must be situated on the same lot as the primary residence; and the proposed boat storage shed was located on a lot separate from the main residence and therefor required a restrictive covenant to combine the four lots into one building site; and WHEREAS, a restrictive covenant tying together lots 5-8 was recorded with the Jefferson County Auditor on October 25, 1994; and WHEREAS, a moving permit was obtained by Robert and Evenell Monica onMay 17, 1996, to remove the boat storage shed from said property; and WHEREAS, an inspection by the City Building Inspector on May 21, 1996, verified that the boat storage shed has been removed from said property; and WHEREAS, the restrictive covenant is no longer required under the Zoning Code (Title 17, PTMC), NOW THEREFORE BE IT RESOLVED by the City Council of the City of Port Townsend that it authorizes the Mayor to sign a revocation of restrictive covenant releasing lots 5 & 6 from the provisions of a single building site with lots 7 and 8, Block 5, Weymouth and Dyer Addition to the City of Port Townsend in substantially the same form as the attached.
