AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING
PORT TOWNSEND MUNICIPAL CODE SECTIONS 2.36.080 POLICE
DEPARTMENT CIVIL SERVICE COMMISSION AND 2.40.020 FIRE
DEPARTMENT CIVIL SERVICE COMMISSION AND ADDING NEW
SECTIONS CONCERNING CIVIL SERVICE SPECIFYING CERTAIN
PROCEDURES
WHEREAS, the City Council determines it appropriate to amend existing
provisions relating to civil service to update provisions relating to appointment of
commissioners, to specify which positions are exempt from civil service, and to specify
rules on quorum.
NOW, THEREFORE, the City Council of the City of Port Townsend does
ordain as follows:
SECTION 1. The following sections of the Port Townsend Municipal Code:
Section 2.36.070 Civil Service system adopted - Police Chief excluded
Section 2.36.080 Civil Service Commission
Section 2.40.010 Civil Service system adopted - Fire Chief excluded
Section 2.40.080 Civil Service Commission
are hereby recodified at Port Townsend Municipal Code Chapter 2.68, and amended to
read as set forth below, and the following new sections are enacted and adopted and
added to the Port Townsend Municipal Code as shown (strike is deleted, underline is
added):
Chapter 2.68 Civil Service
2.68.010 Police Department - Civil Service COmmission
There is hereby created pursuant to Chapter 41.12 RCW a civil service
commission for the police department, which commission shall be composed of three
members and appointed by the Mayor subiect to Council confirmation. The members of
such commission shall hold office as provided in Chapter 41.12 RCW and shall have and
exercise all powers and duties not inconsistent with those prescribed in Chapter 41.12
RCW. In addition, the civil service commission shall have the power to adopt rules for
administration and operation of the civil service system.

accordance with RCW 41.12.050, the position of police chief is excluded from the civil
service system. The police chief shall be directly responsible to the city manager for
carrying out the duties of the position of police chief.
2.68.030
Fire Department - Civil Service Commission
There is hereby created pursuant to Chapter 41.08 RCW, a civil service
commission for the fire department, which commission shall be composed of three
members and appointed by the Mayor subject to Council confirmation. The members of
such commission shall hold office as provided in Chapter 41.08 RCW, and shall have and
exercise all powers and duties not inconsistent with those prescribed in Chapter 41.08
RCW. In addition, the civil service commission shall have the power to adopt rules for
administration and operation of the civil service system.

Quorum - Alternate Commissioners
(1) Two commissioners shall constitute a quorum and the votes of two
commissioners shall be sufficient for the decision of all matters and the transaction of all
business to be decided or transacted by the commission; EXCEPT, three commissions
shall constitue a quorum and the votes of two commissioners shall be sufficient when the
commission is acting to hear and determine appeals or complaints, consistent with
Commission Rules, respecting employee discipline, appeals upon the allocation of
positions, or the reiection of an examination.
(2) The Mayor subject to Council confirmation may appoint standing or
temporary alternate commissioner(s) to serve in the place of a commissioner who is
disqualified from participation or otherwise unable to participate in a hearing on
employee discipline, appeals upon the allocation of positions, or the reiection of an
examination. The alternate commissioner(s) shall be entitled to participate fully in such
proceedings, and is authorized to vote on the action before the commission.
SECTION 4. Severability. If any provision of this ordinance or its application
to any person or circumstance is held invalid, the remainder of the ordinance, or the
application of the provision to other persons or circumstances is not affected.
This ordinance shall take effect and be in force five days after the date of its
publication in the manner provided by law.

Adopted by the City Council of the City of Port Townsend, Washington, at a
regular meeting thereof, held this twenty-first day of July, 2003.
