HomeMy WebLinkAbout97-008Resolution No. 97-08 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND CLARIFYING THE CITY'S INTENT REGARDING PROPERTY LAND USE DESIGNATION FOR PROPERTY OWNED BY PORT OF PORT TOWNSEND The City Council of the City of Port Townsend, Washington, does resolve as follows: WHEREAS, on July 15, 1996, the Port Townsend City Council adopted the Port Townsend Comprehensive Plan by Ordinance No. 2539; and WBEREAS, pursuant to Ordinance 2539, the City issued a final Land Use Map, directing future land uses for Port Townsend, and directing that zoning ordinances and a zoning map be prepared to fully implement the Comprehensive Plan and Land Use Map; and WHEREAS, one of the Land Use designations on the Comprehensive Plan is the "Park and Open Space Designation (P/OS)"; and WHEREAS, the Comprehensive Plan, page IV-11, contains the following preliminary description for the P/OS designation: "This category includes existing City, County, and State owned parks, recreation areas, and City owned lands which provide valuable natural and open space ftmctions;" and WI-1EREAS, the Port of Port Townsend owns certain properties located within the P/OS land use designations. While one of these properties is situated in the Kah-Tai Lagoon Nature Park area, and is encumbered by a City Lease through the year 2012, it is not technically "owned" by the City, the County, or the State. Similarly, Port-owned property in the Fort Worden area is not "owned" by the City, County, or the State; and WHEREAS, like any other property owner within the City of Port Townsend, the Port of Port Townsend has a legal right to request Plan amendments through the annual amendment process. As a good faith measure to facilitate intergovernmental cooperation and to serve the best interests of the public, the City Council hereby agrees to make explicit the Port's opportunity in the future to seek revisions to the Land Use Map at such time as the Port may have control of the property situated within the Kah-Tai Lagoon area, currently leased to the City of Port Townsend, NOW, THEREFORE, BE IT RESOLVED, by the City Council for the .City of Port Townsend: 1. Designated properties situated within the Kah-Tai Lagoon Nature Park are owned by the Port of Port Townsend and leased to the City of Port Townsend for use as a public park. At such time as the Lease from the Port to the City terminates for any reason, the Port shall be free to apply for whatever land use designation which would be consistent with the Port's proposed use of the property at that time. Upon such application by the Port, the City shall review the land use, and the designation as "P/OS Existing Park or Open Space" shall not be controlling. 2. This Resolution shall not be construed as controlling the actions or decisions by future city councils, or in any fashion compromising the legislative authority of the City of Port Townsend to plan for and zone properties within Port Townsend's jurisdictional boundaries. This resolution merely represents the statement that the Port possesses the legal right to seek an amendment of the Comprehensive Plan, and that such amendment will be reviewed in good faith, and that the existing designation shall not control the City's decision and response to the application. At such time as the Kah-Tai property Lease terminates and the Port desires to make an application for Plan amendment, the Port will be required to submit its application through the City's Comprehensive Plan amendment process. ADOPTED by the City Council of the City of Port Townsend and signed by the Mayor on this 21st day of January, 1997.
