RESOLUTION NO. 09-031
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON, AUTHORIZING THE CITY MANAGER TO SIGN ALL NECESSARY
DOCUMENTS AND CONTRACTS FOR THE CONSTRUCTION OF THE UPPER SIMS
WAY IMPROVEMENT PROJECT
WHEREAS, the Upper Sims Way Improvement Project was designated as a priority
project in the adopted 1993 Gateway Development Plan providing for the installation of
improved safety, road and utility facilities along the Sims Way (SR20) corridor; and
WHEREAS, the City of Port Townsend has received allocations through the American
Recovery and Reinvestment Act (ARRA) and the Surface Transportation Program (STP) from
the Washington State Department of Transportation (WSDOT), and the County Insfrastructure
Fund (CIF) for the Upper Sims Way Improvement Project; and
WHEREAS, the City of Port Townsend has received a grant from the Washington State
Transportation Improvement Board (TIB) for the Upper Sims Way Improvement Project; and
WHEREAS, this project has been identified on the adopted 6 year Transportation
Improvement Plan, 2009-2014 and on the City's 2009 CIP; and
WHEREAS, City funding for the project consists of utility funds (for utility work), Real
Estate Excise Tax (restricted to capital projects), and development fees. No general fund dollars
are part of the project budget; and
WHEREAS, the City solicited bids and the apparent low bid of $2,607,913.40 is within
the projected project budget; and
WHEREAS, the City Council must authorize the City Manager to sign all necessary
documents and contracts for design and construction of capital projects.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend that the City Manger is hereby authorized to sign all necessary documents and
contracts for the construction of the Upper Sims Way Improvement Project, within available
funding.

ADOPTED by the City Council of the City of Port Townsend at a regular meeting
thereof, held this third day of August, 2009.
