A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN AGREEMENT WITH
FRANCES M. GRAHAM REGARDING THE PURCHASE OF LAND IN THE CITY AND
AUTHORIZING THE TREASURER TO ISSUE WARRANTS FOR THE PURCHASE OF THE
LAND IN ACCORDANCE WITH THE AGREEMENT
Whereas,
The City, as a designated Urban Growth Area under the
Growth Management Act, is anticipating the need to
construct an enlarged sanitary sewer trunk line based on
projected population increases; and
Whereas,
In connection with the construction of the San Juan
Avenue improvement project, the City will be constructing
a segment of the trunk line from the East side of San
Juan Avenue to the West side of San Juan Avenue in order
to avoid having to disturb the pavement for such
construction after the road work is completed; and
Whereas,
In order to maintain the needed grade for the sewer line,
the trunk line must be so aligned as to necessitate the
purchase of real property in Block 6 of the plat of
Broadway Addition; and
Whereas,
The ownership of additional land in the vicinity of the
facility being constructed to capture stormwater runoff
generated by the improvements to San Juan Avenue will
allow the facility to be sized to accommodate additional
flows that will be created by future development within
the drainage basin; and
Whereas,
Frances M. Graham has agreed to sell Lots 1 through 7 in
Block 6 of the plat of Broadway Addition to the City for
a negotiated price of $38,500, which is an administrative
settlement in lieu of condemnation at a price that is
consistent with the price paid for similarly situated
property previously purchased by the City in iow lying
areas,
N O W T H E R E F O R E
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND
that it authorizes the Mayor to sign an agreement with Frances M.
Graham regarding the purchase of Lots 1 through 7 of Block 6 in
Broadway Addition to the City of Port Townsend for the price of
$38,500; and
BE IT FURTHER RESOLVED that the Treasurer is authorized to issue
the warrants necessary to complete the purchase of the land in
accordance with said agreement.
Adopted by the City Council of the City of Port Townsend and signed
by the Mayor this 2nd day of June, 1997.
