RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND
APPROVING AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF PORT
TOWNSEND, JEFFERSON COUNTY AND THE PORT OF PORT TOWNSEND
REGARDING CONSTRUCTION, MAINTENANCE AND OPERATION OF A
PORTION OF THE LARRY SCOTT MEMORIAL TRAIl., AND ACCEPTING ALL
PROPERTY CONVEYANCES IN ACCORDANCE WITH THE INTERLOCAL
AGREEMENT
The City Council of the City of Port Townsend, Washington, does resolve as follows:
WHEREAS, on July 16, 1996, after public hearings, the City of Port Townsend issued
a Shoreline Substantial Development Permit (No. 9605-04) for Jefferson County's development
and construction of the portion of the Larry Scott Memorial Trail situated within Port Townsend's
municipal boundaries; and
WHEREAS, on July 16, 1996, after public hearings, the City of Port Townsend issued
a Shoreline Substantial Development Permit (No. 9602-02) for the Port of Port Townsend's
proposed redevelopment of the Boat Haven property, including installation of all improvements
necessary for the Port's Enhanced Haulout facility; and
WHEREAS, both the County's Shoreline Substantial Development Permit and the Port's
Substantial Development Permit anticipated the development of a public access trail along the
shoreline of Port Townsend Bay. However, prior to commencement of the public hearings, the
actual location of the trail was unresolved; and
WHEREAS, while the shoreline permits issued by the City Council required the
installation of the public access trail as a condition of the Port's Substantial Development Permit
at a defined location within the Boat Haven, the permit decisions did not fully anticipate the
complexities of trail development through the Port's facility in a manner to minimize or eliminate
potential conflicts between pedestrians and industrial activities. Further, the condition did not
fully anticipate or resolve issues associated with the final design of the trail, and responsibilities
for ownership, construction and ongoing maintenance, as well as trail use regulation; and
WHYS, as a consequence of meetings and negotiations between the Parties, the City,
the County and the Port have jointly resolved all design, construction and maintenance issues, and
have negotiated property conveyances and an Interlocal Agreement to enable the development of
the Larry Scott Memorial Trail within the City's municipal boundaries. Trail construction is
anticipated to commence during the summer months of 1997; and
WHEREAS, as a component of the successful resolution of Trail design, construction and
maintenance concerns, the Port Townsend Paper Company has donated to the City of Port
Townsend the unused/abandoned railroad right-of-way running along Port Townsend Bay, from
the City's municipal boundaries to the Port's Boat Haven property, as well as the railroad transfer
span pier. The Port Townsend City Council accepted this donation on December 16, 1996, by
Resolution 96-154. The transfer span pier is encumbered by a Department of Natural Resources
Aquatic Lands Lease, which will be assigned to the City. The City Council anticipates that the
City will control access to the transfer span pier pending a public decision making process
regarding potential redevelopment plans, including exploring funding from all available grant
programs; and
WItEREAS, the Parties share a common interest in establishing a multi-use pedestrian
Trail within the agreed easement area situated upon the Port's Boat Haven property. The Parties
intend to construct the Trail to link areas to the north and south of the Boat Haven through
development of a continuous waterfront pedestrian "waterwalk" trail system, connected to the
Olympic Discovery Trail, situated in unincorporated Jefferson County. The Parties further agree
that it is essential to take all reasonable measures to ensure that the Trail does not interfere with
Port operations, particularly as uses of the Boat Haven property evolve with construction of
Enhanced Haulout and related improvements to the Port's Boat Haven property,
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Port
Townsend that the Council approves the attached Interlocal Agreement and directs and authorizes
the Mayor to sign the Agreement in substantially the form attached hereto. To implement the
Interloeal Agreement, the Council authorizes the Mayor to accept all property conveyances as
documented in the Agreement.
ADOPTED by the City Council of the City of Port Townsend and signed by the Mayor
on this 7th day of July, 1997.
